潦草。你的问题我可以简单回答一下，权当抛个砖了
1）索赔过程中产生的费用。
传统上和案件有关的费用都是律师先垫付，等赔偿拿到之后再从赔偿中报销。有些客人
会担心，要是律师楼胡乱瞎开单子，客人岂不是很吃亏。这个担心没什么必要，因为到
了分账的时候，客人有权向律师要求详细的费用清单，如果他复印一张纸收你一块钱，
你当然可以合理拒付。我个人所代理过的案件，只要是在提交诉讼前和解的，一般都会
把我们垫付的费用WAIVED掉。如果案子到了诉讼的阶段，律师会比你更在乎在什么事情
上花钱，花多少钱才能以小博大，为客人争取到最好的结果。
2）预先设定的律师费。
这个条款不是每个CONTINGENCY RETAINER中 AGREEMENT都有的。应该说，比较有职业道
德的律师在纯按比分成的案件中都不会暗藏这种按小时收费的条款。这个条款第一不合
理，违背了律师和客人在CONTINGENCY案件里共担风险的原则，第二不公平，如果客人
对第一个律师不满意，换过律师后在第二个律师的努力下达成和解，可是第一个律师的

部都是保护卖方权益的。因为大公司怕某种个别的人捣乱而定的。
基本解释是，公司是君子，但是为了防小人而设了很多条条款款。不是说大公司都会认
为每一个消费者都是小人，而为了公司利益不得不防一些小人的小动作。
就像有的地方规定收现金都要用验钞机，并不是因为你穿的破怀疑你个人的钱是假的道
理一样。怕的是某些人用假钱牟利而已。

和waiver of purchaser's right to sue是两回事。
你可以sue但是不是通过court，目的是降低公司上庭成本。
车行或任何形式的contract，除了利息月付车价外的所有文件说白了都是保护卖方公司
利益的，所以不必纠结。目的就是为了防个例钻空子占公司便宜。
正好拿个当下的新闻来举例，地里被密密麻麻的“种”了很多根本不能用的井，目的是
拿多一点赔偿金。在美国协议里的很多附属文件都是保护资本方不被占便宜的。没什么
好掩饰的。 |
