Timeline: 6.14 efile到NSC，隔天寄出申请材料；11.23得到RFE的online notice，11
.26收到RFE LETTER.
背景及提交的材料包括：
（1）4封独立推荐信，4封非独立推荐信，3封编辑证明/推荐信，1封公司老总专利应用
证明信。这些信总体来源于美国、加拿大、中国。
（2）11个杂志的37次review。
（3）14篇文章，3个中国专利，10个会议摘要。
（4）102个引用，没区分中文/英文、自引/他引。
（5）博后
claim了老三样：review，publication，contribution。

移民法里并没有要求international outstanding，而是national或international
acclaim，至于你如何去找证据证明你的international acclaim就是你该发挥你才智的
地方。
比如用多封来自不同国家的引用你文章的人写信证明他们用到了你的成果，用引用地图
等等。信里面甚至不必出现internationally outstanding，而是用你的证据来证明你
是internationally outstanding。
你总是纠结信里面那几个光亮的词最终是跟自己过不去。 |

舞下RFE的难兄难弟们，积极准备，我们最终也会通过的。 我的RFE信昨天终于收到了
，看了几遍，没有太看懂，在版上看到大家RFE里面都会说什么哪条通过了，哪条没有
通过，我的RFE里面怎么没有提这些？不说费话，下面是详细的全部内容，大家仁者见

我的基本情况： DIY， EB１－A，15篇文章，40次引用，45次审稿（其中有３次
ADJUCTIVE REVIEWER），老三样，引用太弱，用别的东西补充了下，有个联邦政府发给
我们整个组的超级成就奖放在了CONTRIBUTION里面了，好几个小的网站介绍这个奖也放
在CONTRIBUTION里面了，有个联邦政府的头头到我们实验室参观，表扬了我们整个组的
工作，具体说的是联邦政府今后几年要继续依赖我们的工作等等，我们当地电视台有采
访，也放在了CONTRIBUTION里面了。
５封推荐信＋1个期刊主编。包括：一个欧洲（独立），一个加拿大（独立），一个美

sustained national acclaim啊。尤其是在totality部分讲。
当然，在回复contribution时，也可以提及，但是最好在这个后面加一句说although
this is after the initial submission, it strongly support top percentage and
sustained national acclaim这样的话。 |

发帖数: 4778 | 9 坦白说case不强，所以一定要精心准备。EB1B虽然有雇主支持，通过率的确高，但主要
一点的是，EB1B强调international acclaim，所以citation很重要。对你的case来说
，独立引用45，似乎有点低。所以你要精心准备，重点claim两项，突出你是
outstanding, 并且international acclaim。

percentile较低的是94%和96%， 首先请问，这样的百分比是可以acclaim的吗？其次，
怎么表述合适？可以表述成比如top6%， top4%吗？
2.我有5篇文章根据ESI percentile，分别一篇是0.1% 另一篇明显>1%，但又不到0.1%
（初略估算可能在0.5%左右，但是ESI只给出了1%的数字）， 余下的3篇是在10%以内。
请问10%内的3篇文章是不是不适合acclaim， 要是只present另2篇，又会不会被RFE说
contibution不够呢？除了这个ESI percentile还有哪些数据库和方法可以让文章排名
更高些呢？
3.如果想比较我的文章和其他在相同杂志表的文章的citation，哪种方法合理。举个例
子说下我现在的方法。我有一篇2009年的文章发在某杂志。我可否计算此文章在所有
2009-2014年发表在相同杂志的文章中的citation排名？自己认为这并不合理，因为最

刚收到律师的信说他收到了NOID。
我们单位是美国去年第一的医院，只给senior的researcher办EB1B. 律师说这还是第一
次收到NOID，说“ we have never gotten a response like this from a case like
this so we believe it is some kind of adjudicator error”.
这真是晴天霹雳啊。
看下面的回复，好像是三样都有，但都不够strong啊。

对的, 老三样里面就judge这条最容易, 然后award要比老三样难很多.
最讨厌的就是IO会说contributions要"in the plural"...
不过还是要小心一点.
如果仔细去读移民法里的实际规定 8 C.F.R. § 204.5(h)(3), EB1A要满足的3 out of
10 criteria并不只是字面上达到要求就够了, 因为这10条都是"evidence that the
alien has sustained national or international acclaim and that his or her
achievements have been recognized in the field of expertise."
所以在present你的case的时候一定不能满足于达到3条的字面要求, 一定要reiterate
这些evidence是如何说明你有sustained international acclaim + recognized

收到RFE的时候心灰意冷，放了一周，然后死马当活马医的心态。加了3篇新发表非一作
的文章，一个国内市级科技进步奖（名次很后面，好在有独立奖状），2个专利转让合
同，19篇新审稿，一份证明材料翻译的公证。
本来还想加推荐信，或者修改推荐信，考虑到一来一回又很久，于是放弃。
然后contribution的材料整理上换了描述方式，本来说自己有3个贡献，每个贡献下有
多少文章，多少奖励，推荐信里的话等。交RFE的时候，就分为两大部分。一部分说了
新提交的材料，用来证明“Sustained national or international acclaim”；第二
部分最开始提了3个贡献后，罗列文章，引用（原来证明第一部分文章的材料），参加
会议（强调会议级别），获奖情况，专利和转化，申请课题（课题资助比例），推荐信

关键是这个RFE没有任何具体的针对性，完全就是把EB1A的要求复制了一遍。这样的RFE
该叫小弟怎么回复啊。请教班上有经验的同学，我的petition letter是被弄丢了么，
是该把所有的材料重新file一遍么。还是重新把petition letter 和evidence按照
response的格式重新精简整理一遍？这也等于要把所有petition letter 再交一次,加

个人感觉背景不算弱，于是之前都没怎么在版里学习，省事找了版里挺有名的律师，律

VO还是仔细看了我的材料。最终他承认了contribution，但final evaulation没有过。
一方面质疑我sustained acclaim，说只是近几年有很好的paper，引用也比较多，但不
足以说明sustained acclaim （可我进入这个领域也没有太久。。）；另外，就是质疑
top-ranking，确实原来的论证中，仅仅提到了个别文章citation的top-ranking，没有
太多的内容。
目前感觉自己在contribution上已经挖掘了不少，但还是不知道该怎样和同行的top-
ranking researcher做比较。除了在推荐信中的一些证言以外，从哪里能找到一些客观
证据呢？比如同行的平均引用率？

Liu Xiaobo for not using red color, the
national color of China, in his paintings
for continuously over 20 years now. Liu was
already in jail since 2008, after being
arrested for painting a black rose even
though one is supposed to imagine only red
