当时I-140批准的时候，律师只给了我I-140 approval notice的正面(有我的A#,PD
date和 EB2类别)，没给我反面 (可能是忘了扫描反面)。请问如果光有I-140 approval
notice的正面，没有背面，能做为可以保留老PD的证据吗?
另外还需要perm 批准的那份材料（ETA 9089）吗?律师说这个是公司所有，不肯给 |

然后J20 "Does the alien have the experience in an alternate occupation
specified in question H10", 律师给填的答案是Yes
H6 是说这个工作要求本科+5年经验 with the job title as "senior system analyst
"
H10 是说 "alternate occupation acceptable".
律师解释为什么J18要回答NO, 是因为那个我没有job title "senior system analyst"
下的5年经验,
所以她在H10里填了一系列的其他job title, 这样就可以说我有5年在这些job title的
经验了, 因此J18答案是No, J20答案是yes.

发帖数: 281 | 9 我的表上写得也是NO。我公司律师的回答是NO确实会增加AUDIT的几率，但是YES容易被
DENY。他说现在DOL的job requirements比较低，比如IV类都不需要advanced degree，
但是在industry里类似职位大都是advance degree，所以按照DOL的规定就不是normal
的requirements,所以老实写NO比较好。希望律师讲得对吧。我的PERM交上去快两个月
了，还没有消息。 |

标 题: 急问msft perm打广告有美国人应征怎么办？

刚收到律师电邮，说有美国人应征，所以要等半年再打广告。这种事情很少发生吧？而
且我的职位要求至少masters以上。。。感觉很倒霉。下一次要改改job description，
让广告更找不到人吗？
比较诡异的是，几个星期前律师还让我确认9089表，说perm已经可以准备file了，签好
字的推荐信也早已经交给律师了。今天却说就是在这最后几星期内有美国人应征。这个
解释靠谱吗？
急求有经验的xdjm帮忙看看，谢谢！ |

发帖数: 434 | 16 最好你给老板抱个总价格.然后问老板能出多少,其他的自己出.
最好APPLICATION FEE要由老板出.律师FEE自己出.另外自己出的部分让老板能不能从税
前工资里扣.你可以把律师FEE调高一点.这样老板如果能出APPLICATION FEE和PERM的律
师FEE最好.
另外140和485可以自己DIY.当年我老板要是愿意让我自己弄,我全包都行.可是人家死脑筋,非得按照公司流程来.拖个一年半载才FILE PERM.自己办,估计140都下来了.
办绿卡这点钱,以后跳槽二个月就回来了.
另外:PERM皮了,H1是一年续,140皮了可以三年续.140批的时候可以花1000加急.15天内批.
最关键自己清楚GC的流程和大概时间,游说老板才游仁有余.

485交后半180天可换工作(不需重办PERM和140). |

披完立刻140，就算中间准备1个月，上PP， 15天也下来了。
所以最快时PERM 60天+30天140准备+15天140PP= 105天。当然这是最最好的情况。 |

in the form. 我应该回答No,还是Yes, 然后回答问题10A,zero(if YES, number of
months experience required). 因为job不需要工作经验. 我觉得应回答N/A, 但是表
里没这一选择.

labor certification (perm 指的就是这个）， 如果律师在线提交给department of
labor，提交labor certification的日期就是你的pd。这步批了，你就拿到了所谓的
certified perm application, 或者说certified 9089 form，这个form半年内过期，
必须半年内提交i140，提交i140的日期并不是你的pd,实际上perm的i140的receipt上会
用你labor certification提交的日期作为pd。
niw 由于不需要labor certification这一步，所以提交140表日期就是pd。
我perm和niw两个去年刚办过，以上肯定是没错的。

但我的职位和薪水还有工作内容都没变。file140的petitioner是这所大学，但perm的
9089表上有这个center原来的名字。这种情况将来file485时用说明一下吗，还是都无

Just know that my PERM is audited today. DOL asks recruitment process
documentations. Job resuirement is M.S. in computer science + 0 years
experience. Lawyer said there is one U.S. citizen applicant, but he was not
quallified. What I am worrying is that in job description, I wrote a lot of
skill sets (Computer languages, operating systems, etc.) and it is very long
, about 13 lines. If that aplicant matches 2/3 of the required skills, will

我的绿卡之路才刚开始。以99年8月来美留学算起，这应是很慢的了。05年8月到这分公
司，开始总公司HR一直不愿意给我办H1B，直拖到06年10月1日我才拿到，害得我OPT结
束后费尽心思注册学校，弄到两个CPT来继续上班直到拿到H1B。
07年初就缠着我的经理办绿卡。她到分公司VP和CEO那里去游说。大约07年中得到分公
司批准。9月总公司HR让我给了简历说是用于启动我的绿卡案子。10月我闹了个跳槽风
波，但接受了公司的match留下来了。公司办绿卡，优点是公费，缺点是自己使不上劲。
下午（08年3月26日）经理说我的绿卡广告引来了“quite a few”申请简历。HR要她找
些技术问题和答案以便电话过滤申请人。经理不懂技术，我便写了五页的简短问题和答
案及一张Visio做的图表明工作需要的知识面和各部分的比重。4月1日经理出差回来，
