的信息，想搞清楚

I applied for NIW by this March and just got it approved in NSC. In June, my
company stated to apply for EB2. Two weeks ago, EB-2 was in prevailing wage
determination. I am not clear its current state.
Is the next step to wait for my PD, and once my PD becomes current, and
submit I-485 by myself?
Now should I let my company know my NIW? Should I have both or NIW only or
EB-2 only?

PD按我google的理解是指140批了以后，你SUBMIT PERM(ETA FORM 9089)那个日子。注
意必须是140批了，所以我不太清楚你EB3 PERM批了，但是不交EB3 140,继续搞eb2
perm 140,是否还能relink EB3 PERM.
另外PERM过程是指：
1. Prevailing Wage Determination (1.5 to 2 months)

和h1b工资用的一个系统，通常level I to IV.
一般, EB3: Level I, EB2, Level II，也可能EB3 level III, IV,取决于你的job

You are right that I just got to know that my husband should have had his
old submitting date for 9089 on his new PERM, but our lawyer didn't check
Yes when he filed the application for PERM. So on his PERM, surly 2007 is
not eligible for 245i.
We were suggested to file 9089 again and check YES to choose old submitting
date, so he can have 2001 on PERM.

把我工作中用的软件都写上去了,写的很具体.因为我的广告的job description 就是这
样写的(工作需要的skill). 我会不会被audit?因为写的太多太具体.DOL think it is
too "restrictive"?
有些人说有些skill如果能在reasonable time 学会就不能要求申请人在申请时已具备
这一skill. But what's reasonable time?
在填form 9089 时, Is training required for the job? No.

一个傻逼美国移民律师，我单位同事他的妹妹，价格也不是特别便宜，4000刀，先付
2000刀打广告，然后把ETA Form 9089递上去了，交剩下的2000等140批了。这律师傻逼
，填表时候没有按照人家规定的格式填，而且还有好几个空没有填全，导致该次申请被
拒，于是律师意识到问题的严重性，在规定的时间之内，把新的表格递交上去了，于是
我的case就被归类为“reconsideration submitted to CO”于是就在等这个类别的
priority date，还好最近跃进的幅度比较大，但还是迟迟的没有消息。联系律师，律
师说DOL那边还在等我的employer给他们发我工作的verification，在百般催促下，律
师终于把这个电话催到了，DOL的人给我们公司的HR打电话，确认完了我的工作状态后
，在2012年的最后一天，发信告诉我们公司以下信息：

我从来没听说过什么0-4 4-7的选项
工作要求的一个忌讳是量体裁衣，针对applicant提要求是会出问题的
你这里更严重的问题是看起来你再加入这家公司之前的工作经验是不能计入的
你明确一下吧，ETA-9089上要求的工作经验是几年，你加入公司前有几年经验
如果这条不满足的话，就难怪会不经过audit直接拒掉了 |

感觉USCIS这个理由有问题啊。
PWD是2/2014 - 6/2014， 你广告在2/2014开始，最后7/16/2014递交PERM 9089,说明
recruitment最晚在6/16/2014就结束了，然后cooling down at least 30 days,然后交
PERM 9089,可能是我知识不够，反正我没看出上面的TIMELINE有任何问题。
刚刚google了一下，发现你可能很不走运，你没列出PWD的开始日期到底是几号，我猜
测是2/2/2014以后，这样拒绝你就合理了。
你让律师把9089 form上那个I recruitement发给你看看，看看什么广告是在PWD以后开
始的，之前的广告重新做一下，或许能避免重做一些广告，然后再交PERM，或者file
motion to reconsideration,不知道哪个时间更快，问问其他律师。

1 请问这种打未来职位广告的，job detail上应该写现在职位要求还是未来职位要求？
2 象我这种情况，广告需要重新打吗？

一篇一作占引用数的一半。当初除了请老板写推荐信，还有四个独立推荐人。不知道该

original ETA-9089 不在Nebraska Cneter, 所以Form I-907 被拒了。 可以在60日后
再file Form I-907。

1. Certified， 或Certified-Expired 都算批准
2. Salary is "WAGE OFFER UNIT OF PAY 9089". if it does not exist, then it is
"WAGE OFFER TO 9089".
3. Some computation might be wrong. For example, I set all teachers work for
12 months, this may be wrong (they get paid for 10 months).
And there are some wield cases, like Freescale guys look to earn too much (>
150000/year). But generally, I think 99% case is correct. Anyway, it is only
an estimation.

1、律师说可以降级；AILA说USCIS接受基于旧的EB2 Labor Certification的新的EB3
I140申请。
2、雇主（HR）已答应给钱；雇主不给PP费用。
3、PP可以自己出；如果PP被拒，钱会退回申请人；没有PP审批大概3-5个月。
4、EB2的I140仍然有效，如果EB2又比EB3快，可以用EB2的I140。（不知道是否需要再
提交485及另外交费）
5、（如果新排期不倒退，）由于EB3已经Current，因此可以双飞485。雇主支付485费
用。
