is out of legal status immediately. Unlike J-1, there is no grace period for
H-1B holders. The laid off H-1B employee is deportable under the immigration
law. However, in my over 14 years practice, I have never seen CIS (INS) take
such an action against any laid off H-1B holders.
However, that does not mean you can sit on your laid off status and do
nothing. CIS leniency does not provide a safe harbor for you to file an |
