这前前后后差的也太多了吧。
关键是，这一年我该怎么办？

Remember: In usa, always keep evidence and show your evidence when you argue with them.

secretary's mistake.
It happens to me today, I argued with secretary and she acknowledged it was
her mistake.

以说法不一。最后终于是前后同一个人接电话了，居然不记得我了。
拿着录取信到学校报到，登记住宿的时候，居然被告知，“你不是我们学校的”。把我
吓死了。留了电话，刚走到楼下，电话打过来，说发现我确实是学校的。
从头到尾都是小错 |

月份申请的，一直拖到４月份才给消息，过程很煎熬，本来要回国了，但一点心情都没

2011 semester and was admitted in early April. I was very surprised to
receive a letter on May 16 from the graduate school that my application has
been denied.
I applied for master programs in two universities last November. In early
April
I received an email (attached) about my admission to the graduate program
at GSU, which I was very excited about. I then contacted the other
university and withdrew my application since GSU is my first choice.
Now I'm a little bit confused about the latest notice. Could you kindly
confirm that it's just a system error and my admission into Fall 2011 master
's program in XX is still official? For your reference, my interest is in
XXX and I prefer Prof. Y as my advisor.

这个情况应该是这样的，学校原来有5个grad stu的funding，但现在经济不好，只有2
个grad stu的
funding了。cut funding的情况现在太多了，只不过看学校怎么支配。想这个系这种把
已经发出的
offer收回的实在不要脸。但是如果真是没有funding，那也没办法。可能的解决方案也
就是说没奖学
金，变成addmission，或者推迟1年入学，系里明年筹钱给奖学金。

是发错了。你可以直接和教授联系上学课程适宜或其它与录取无关的事，只要这些都落

normally, many people can get this), but department declined.
Most of cases, it is the department has the decision power, graduate school
is joke.
Seems LZ is this situation. He never got the offer letter from department.

an empty check from graduate school.
We got many those kind of empty checks when we applied. We all know it is
useless, and only the department offer letter count.

然后会给你一个deadline让你accept这个offer，一般是2，3个星期。
最后有dean的手写签名（这个很重要）
有的学校还直接把学号什么的，申请学校宿舍的方法之类告诉你。。。

很多年前 大概00 01年的样子，连I20都拿到 都准备签证了，然后一个email把offer
收回，最后怎么样不清楚 |

Let’s start with the question 1: was there a contract formed between the
school and LZ?
Contract formation requires mutual assent to the same terms by the parties,
generally manifested by an offer and acceptance. When the school sent an
email to LZ with the following content “Congratulations. You have been
accepted as a graduate student at ＸＸ University”, it was an offer from
the school.
LZ then called the school and said “yes, I accept”. That was acceptance.
The acceptance was done when the offer was still open and valid.
So there was a contract formed between the school and LZ.
Some people say “it’s just an email! And it might not from the school”.
From the facts LZ provided, “the school has admitted 5 people, but somehow
only 2 offers will be honored”, we can imply that LZ was one of the 5
people initially admitted. That means LZ indeed got an offer from the school
initially. After LZ called and accepted the offer, the contract was formed
between school and LZ. I don’t care why the school came up with some BS of
only 2 out of 5 will be admitted.
Ok, I know some of you argue that the email offer might be a mistake. In
this situation, LZ can still sue them on negligence. LZ relied to her
detriment (declined another offer, and have no other choice but wait for one
more year now) upon the offer. And such detrimental reliance was reasonably
foreseeable by the school. The school had a duty to make sure such mistakes
not to be happened. If there was such mistake, they breached their duty.
Their breach directly caused the damages on LZ. So LZ can still sue for
recovery based on negligence of torts law. |

Yes! LZ relied on the school’s email (offer/promise) and declined the offer
from other school. That was a detrimental change of position by LZ. And
this detrimental change was definitely a foreseeable event by the school. As
I mentioned in my previous post, the doctrine of promissory estoppel makes
this contract enforceable. So the school has to honor their offer to LZ. |

in graduate admisison office and the department.
Department makes decison first and the program coordinator will sign the
offer letter;
Department secretary forward all materals to graduate admission office;
Dean in the graduate admission office will review all offers and sign the
offer letter;
graduate office staff will mail the official letters to applicants. Done!
You should not receive any email offer as far as I know. I never received
any email about acceptance from Department or gradute admissin office.

contract, even if it is a mistake made by an individual school staff, the

The first email does not look like something a decent
school will send out. The OP should go back and read
that email again, and check the source (full header,
etc.)
There are cases when admission letters were sent out
by mistake. In one reported case, the school apologized
and told them it was a mistake. In another (unreported),
the school admitted all students who were sent the
letter (they were on the lower priority waiting list).
Consequently, those on the higher priority waiting list
were denied.
However, I can't imagine the mistake was not caught
for one month. There is absolutely legal ground to sue.
Any school will not want to go to trail. The cost of
going to trail is too expensive to anyone except
perhaps Harvard. Not to say it's a case the school
has no chance of winning.
So I doubt the authenticity of the story, but believe
the OP should not worry if what she said was true. |

but later they withdrew due to limited fund available.
