近日，记者获悉，原北京玄鸟文化传媒有限公司（简称：玄鸟公关）员工边某某，在该
公司工作期间，涉嫌损害商业信誉、商品声誉罪，被公安机关刑事拘留。案件的起因，
可以追溯到2014年8月的一则网络造谣传谣事件。
2014年8月11日下午，东方财富网、和讯、天涯等多家论坛上，出现了一篇关于中国移
动网络故障的文章，同时，大量海外电信运营商也收到了该文章推送信息。该文章编造
了大量虚假信息，包括捏造中国移动TD-LTE的网络故障，伪造中兴通讯员工的内部言论
，杜撰中兴通讯公司的研发情况。以上虚假言论，给两家大型通讯企业——中国移动、
中兴通讯的声誉及财产造成了重大损失。
针对近年来日益增多的利用网络造谣诽谤、控制舆论的违法犯罪行为，国家已出台《关
于办理利用信息网络实施诽谤等刑事案件适用法律若干问题的解释》等一系列法律法规
。国家互联网信息办公室、工信部、公安部也开展联合行动，在全国范围内集中部署打
击利用互联网造谣、传谣行为。
前述网络造谣传谣事件公安机关立案后，前往北京、上海、海口等涉及发布假消息的网
络论坛办公所在地进行调查，并通过技术手段锁定嫌疑人信息。2015年3月下旬，警方
采取抓捕行动，抓获犯罪嫌疑人玄鸟公关公司边某某，并以涉嫌损害商业信誉、损害商
品声誉罪对其依法予以刑事拘留。
目前此案正在进一步办理过程中。消息认为，公关公司的幕后是ZTE的主要竞争对手--
华为。

at the increasing criminal acts of controlling public opinion by starting
and spreading rumors on the Internet. The State Internet Information Office,
the Ministry of Industry and Information, and the Ministry of Public
Security also carried out joint actions to combat the acts of starting and
spreading rumors on the Internet.
After filing the above case of starting and spreading rumors on the Internet
, the police went to the offices of the network forums in Beijing, Shanghai,
and Haikou for investigation, and locked the suspect information through
technical means. In late March 2015, the police took action to arrest the
suspect Bian of the Newsbird Media company and detained Bian on suspicion of
damaging business reputation and product reputation.
