Dear Sir/Madam,
I am writing to inquire about whether an event happened in March, 2013 could
be defined as charity fraud according to the law.
On March 8th, March 9th and March 14th, an ID called lilykang (real name:
Lei Kang) began to post on the biggest Chinese community discussion forum in
United States (www.mitbbs.com), saying that her husband Yin Yu just passed
by because of gastric cancer. She stated that she was a full-time housewife
with three children. She claimed that she had life hardship: her elder son
had autism, and her younger daughter was only two years old. Her posts
aroused a lot of sympathy and bless on the forum at that time. Then she
posted donation information (P.O. Box, paypal and bank account) in one of
her posts, saying that a lot of people sent her messages to ask the donation
information. Later, an organization called American Chinese Culture and
Education Foundation (ACCEF) get involved http://www.accef.net/ to encourage people to donate through their website to save tax. Many kind American Chinese people made donations to this family through different ways in March 2013. Without disclosing her financial situation, she even collected donations from Fudan University Department of Physics in China which raised at least 200000 Chinese RMB (around USD$30000) from alumni and even students.
In April, 2013, the situation turn around sharply. Some insiders disclosed
that Lei Kang's husband Yin Yu is a senior engineer in a big US
telecommunication company (Qualcomm), and she can have over one million
dollars after her husband passed by (company compensation, life insurance,
her husband's stock account, etc). As more and more information was
disclosed, people knew that her son's autism was diagnosed by herself, not
by a medical doctor. In July, 2013, after three months of her husband's
death, Lei Kang purchased a single house in San Diego with full cash $540,
000. Moreover, Lei Kang was found to be a member of the donation
organization ACCEF, and then ACCEF is found to be unregistered. What make
people even angry is, up to now, Lei Kang, as well as ACCEF, refused to make
the total donation amount public, even to the donators.
Could you kindly tell us whether this event can be characterized as charity
fraud? If yes, how could we contact the related people to launch
investigation on both Lei Kang and the organization ACCEF? What kind of
evidence we should collect?

and needed rescue: her eldest son had autism, and her newly born daughter
was less than two years old. Her posts aroused a lot of sympathy and
attention on the forum at that time. Shortly afterwards, she
posted donation information (P.O. Box and paypal account) in one of
her posts on www.mitbbs.com, claiming that hundreds of readers of her
previous post had sent her requests for donation methods. Several days later
, an organization called American Chinese Culture and Education Foundation (
ACCEF) got involved http://www.accef.net/ to encourage people to donate through their website to get tax benefit and to qualify for potential dollar-to-dollar matches from QualComm. Many kind American Chinese people made donations to this family through different ways in the following months in 2013. Without disclosing her financial situation, Ms Kang even collected foreign donations from Department of Physics at Fudan University in Shanghai, China. The amount raised abroad at Fudan was later on released to be at least 200,000 Chinese RMB (around USD$30,000). Ms Kang refused to release the total amount collected within the United States.
In April, 2013, some informants disclosed that Ms Kang's husband Yin Yu,
being a senior engineer in one of the biggest telecommunication companies (
Qualcomm), had left Ms Kang over one million dollars (company compensation,
life insurance, stock account, 401K, etc). As
more and more information was disclosed, people started to question whether
her son's autism was diagnosed by a medical doctor. At least the amount of
social security survivor benefit Ms Kang is receiving suggested not. In July
, 2013, after three months of her husband's death, Lei Kang purchased a
single family house, her second property in San Diego County, with a price
of $540,000 and no financing. Moreover, both Lei Kang and her late husband
were found to be members of the donation organization ACCEF. ACCEF is
confirmed to be unregistered with the California government and could be
falsely advertising tax and match benefits for donations to Ms Kang.
Could you kindly tell us whether this combined act of Ms Kang and ACCEF can
be characterized as charity fraud? If yes, how could I contact the
authority or law enforcement to launch investigations on both Lei Kang and
the organization ACCEF? What supporting evidence should I collect?

For IRS, tax is the key point. Whether ACCEF or the "Yin family fund" is
legal for tax deduction.
For FBI, charity felony is the key point. Keep all the evidence! Keep the
