的院子里。邻居觉得不爽。他担心风大的时候枝叶可能会砸碎他们家玻璃，或者来了台
风，树倒了，会砸到他们家房子。所以，他现在希望我们能把长到他们家院子的枝叶给
剪了，或者最好，我们把这棵树给拔了。
我现在有以下两个问题，
1）这种情况下，我们有义务或者责任把长到邻居家院子的枝叶给剪了吗？因为，树很
大，没法自己剪，我们得请人剪。
2）如果真像邻居担心的那样，这颗树或者它的枝叶给邻居的房子带来任何的损失，我
们有义务赔偿吗？
我们住在加州，感觉这种问题应该很普遍。不知道，哪位有遇到过，怎么处理的？应该
有相应的法律条文吧？哪位知道具体是怎么规定的？

2 no. A few weeks ago, somebody posted here, saying they just moved in their
recently bought house, and neighbor's tree crashed into their house. they
asked for advise. people said to go to their own insurance company and claim

If your neighbor didn't warn you in advance, then you are not responsible
for any damage that your tree causes. However, if your neighbor gave you a
notice beforehand, then you will be responsible for whatever damage your
tree will cause in the future.

2. No, it's act of god, if your neighbore worries abouth the limbs, they can
cut any braches in their side, same idea here, if you plant an apple tree,
any apple falls in their side is theirs.
if you ask any american co-worker, they will give you correct answer since
they deal with this issue for 100 years.
there is one catch, if the tree is dead and post imminent threat, you are
responsible for removing the three, otherwise, ask your neighbor to pay for
removing the tree even it's in your side. |

should trim it or cut it down. If the tree belongs to a neighbor, there are
several ways to approach the problem.
Talk first. Do not assume that your neighbor is aware of the dangerous
condition. Talk to your neighbor and explain the situation. Once informed,
the neighbor may be willing to pay for some or all of the expense involved
of eliminating the hazard.
Put it in writing. If the neighbor is not willing to take corrective action,
write a letter explaining your concern and enclose a copy of the arborist's
report. That way the neighbor is on notice that he or she will be held
responsible if you or your property is harmed.
Get help. Next, notify your local government. Many cities will step in to
correct or make the owner correct dangerous conditions. Some cities will
remove the hazard and bill the owner if the owner refuses to take
responsibility.
Do it yourself? Legally you can cut off offending limbs up to the property
line as long as you do not cut down or destroy the tree. |

So for your first question, they are responsible for branches in their yard.
They have the right to cut it even you don't agree.
For your second question, if they send you a certificated mail, you will be
hold responsible for any damage. |

duty:你的邻居是foreseeable plaintiff，你的standard of due care at least is a
reasonable person under similar circumstances
加州最favor的案子Rowland v. Christian，里面共7条test，我大概估计了一下，你
100%有duty
breach:如果有人员或者property损失，Learned hand's test:你没戏了，其他的
community expectation test:你没戏，
causation: but-for your negligence, your neighbor won't have suffered such
consequences. Your negligence is the proximate cause of their suffering.
damage:人员受伤至少$1million
上庭你的胜算极小。

发帖数: 2718 | 16 我们自己家的树当然是每年要请人修剪，而且特别叮嘱把过邻居家那边的都要剪掉。
再说别人家的树吧，有一棵进自己家后院的，不知道什么树，树枝特别脆，有一棵
是投资房侧院的，棕榈树。刮风就掉枝枝叶叶，而且还压到 fence, 抗议了一段，
后来他们都找人把树给锯了。
也在加州，不过两个区的人都比较 decent 的说。 |

几个月前我们这里来了台风,邻居家一棵大树倒了.
倒在另一户人家的后院,差一点点就压到房子了.
结果主人家(其实是租的)什么表示都没有,被压的那一户(也是租的)就报警,
后来警察来了,也不管,说他不是他们的业务范围.
问保险公司,说不是主人家的责任,
后来是被压的那一户的保险公司,付钱把大树搬走,花了好几千. |

我们打算问问自己房子的保险agent，看看他们怎么说。
我们不是要逃避什么，只是初来乍到，第一次遇到这种事情，不知道该怎么办。如果是
该我们做，或者出钱的，我们会做；如果不是，我们也不想做冤大头：） |
