话说早上送儿子上学，很窄的一条路，车子都堵在那里等着进学校，我就跟儿子说，老
爸今天不等着拐学校停车场了，让他下车自己走过去。就在他开车门的一瞬间，惨剧就
发生了。一个骑车的哥们儿一头就撞到车门上，然后叽里咕噜的的躺地上了。我就呆在
那里傻了。脑子里闪现出各种可能发生的。。。。。。。。。
长话短说， 他的人，俺的车，都无大碍。倒是把孩子吓了一跳。
要说错误在谁，首先我不该不看一下后视镜，但是骑车的人也有责任。比较复杂，不细
说了。我记得当年学摩托驾照的时候， 小心停着的车开门是非常要注意的。教训呀。
什么事都凑巧了，所以就发生了。不过提请开车的，汽车的都要注意呀。特别是骑车的
经过停着的车的时候，这种开门的机率大增呀。 |

一般车门都有个开关，开了后，后门从里面就开不开了，防止小孩没看后面就突然打开
车门，后面来的车撞上打开的车门。

motorist is able to and legally allowed to walk or ride between parked/
stopped cars. That's probably a law based on the common sense. Drivers
shared the road with other drivers and walkers/cyclists/motorists, and even
the pedestrians. In addiiton, it promotes less energy consumption and more
active and healthy life styles.

not at this point. Since you've stopped your car, and you may not have
turned on the emergency light, he surely can pass your car (as you said
before that car and bike share the same lane), because no one would expect
the door on your car would suddenly open.
So you should consider yourself very lucky that the biker did not sue you. I
am not a lawyer but my bet is that you will definitely lose if you sue the
biker, and he will sue you on return.

Sure if I stopped on the middle lane and my door knocked him out, it's my
fault. Not to deny my responsibility here, but in this situation he was

this whole thing. The poor guy had a scare as well. I empathize what you
guys have said here, and I agree the cyclist is more vulnerable in this
situation. But to say who is at fault in the court of law is not this simple
. I agree the burden of proof is likely laying more heavily on my part to
provide evidence to defeat the ‘presumption’ of negligence. I can present
evidence of fault (negligence) on the part of the cyclist that ‘contributed
' to the accident. The bicyclist might be distracted because of wearing
headphones, or might be going too fast. The judge or jury weighs all the
evidence and decides not only the fault of the me, but also whether the
cyclist is at fault (comparative negligence) and, if so, what percentage to
allocate to each side.
A lesson for all is to be mindful for cyclist sharing road with you. |

ride motorcycles too, so I totally understand the whole thing. Being doored
by car is one of the biggest topics in motorcycle safety class. Now I
probably have to thank my LD for repudiating me repeated attempts to buy a
motorcycle again.

你在路边停下， 开车门的时候，一定一定要看后面的情况！！这种情况在国内发生很
多次了，都是开车门的全责。
尤其是你这种情况，那么多车停着，等着进某个地方，骑自行车的人，根本不可能假设
每辆车要开门，那样他就别过了，老实在后面停着吧。
另外， 你拿摩托驾照的时候，说要防范路边的车突然开门，那是减少事故的防范性措
施，就象你在路上驾驶，要防止有人突然乱穿马路一样，不是乱穿马路是对的。
