Difference? One faced a warrant for prior charges of armed robbery when
accidentally shot while seeking to escape arrest; the other was deliberately
shot for trespass on public property. Guess which cop charged?

break into restricted area by force thus deadly force was used.
Cut and dry, easy peasy.

Resisting arrest can have deadly consequences, he might get in his car and
reach for a weapon and shot the officer(s), can drive under high stress and
cause deadly accident and kill innocents... Ashley was unarmed, with at
least three cops watching her entering the broken window, did nothing, they
could have pulled her down and arresting her.

defense of "fear for his/her life" will be challenging in this case as the
ex-officer obviously intended to use taser rather than gun as she shouted
taser and was shocked that she shot him.
As for Ashley, I do not understand what you tried to imply. Assuming what
you said is true, the police also could have done a lot of things, such as
deploying more aggressive tactics early on to prevent the insurrectionists
storming the Capitol, but didn't. What the police did or did not do on that
day has no bearing on what should be the legal action.

| h*******g 发帖数: 1 | 5 It was unfortunately an deadly accident, if Duante was not resisting arrest,
the veteran cop would have no need to pull anything to restrict him other
than handcuffs.
As for Ashley, something was very odd with the capital police behavior, they
behave very differently separated by a thin wall; if the area was so
restricted, why didn't the cops on the other side stop the protesters to
break the window and/or stop Ashley from entering the window?? They were
neglect of their duty and should be partially responsible for Ashley's death
, along with the one killed her of course. Btw, the lawyer of Ashley's
family rejected the department of justice's decision on closing the case and
not charging Ashley's killer, the lawyer will further pursue this matter as
a civil case. Let the killer's name be known, first step.
