1. 如果UNION罢工, 公司是否可以把罢工的员工开除?
2. 如果UNION罢工, 公司是否可以雇请新的员工临时顶上?
3. 是否会发生只有一部分员工去罢工的情况, 还是全部罢工?
4. 是否会出现UNION堵住路口不许其它员工上班的情况? 如果有, 这是否违法?

NO, Government target is not to protect tax payer, but to protect their own
job and vote. That is why a lot people think public sector union is illegal

As long as I am allowed to find new employees to work for me, and get rid of
those employees go on strike, then it's a fair game.
It's the company's responsibility to control the risk of a sudden leave of
all employees. And most companies are already doing this at a smaller scale.
i.e., every job has a backup employee.
The key thing here is: The Union should NOT beat up the new hire or block
the street, it should be a felony, and people need to go to prison for this.
Or else, it's not a fair game.
But actually I've heard in some states, you can not hire people from outside
the union, and you can not fire employees on strike. California is one of
them?

I mean, this is a war between Union and Business. Nothing wrong about it. As
long as everybody play fair and square.
I can convince your employee to join my union, you can also convince my
union worker to quit my union.
As long as there's no violence, no block of the street, I am fine with Union.
And I should be allowed to shut down my business, and start a new one. The
boss will suffer if he does this, but the employee of suffer too. It's a
game/bluffing.....
But if the law are against the business, for example, you can't shut down,
you can't hire employees outside of the union, ...., etc, then we have a
serious problem.

In the U.S., as established in the National Labor Relations Act there is a
legally protected right for private sector employees to strike to gain
better wages, benefits, or working conditions and they cannot be fired.
Striking for economic reasons (i.e., protesting workplace conditions or
supporting a union's bargaining demands) allows an employer to hire
permanent replacements. The replacement worker can continue in the job and
then the striking worker must wait for a vacancy.
But if the strike is due to unfair labor practices ULP, the strikers
replaced can demand immediate reinstatement when the strike ends. If a
collective bargaining agreement is in effect, and it contains a "no-strike
clause", a strike during the life of the contract could result in the firing
of all striking employees which could result in dissolution of that union.
Although this is legal it could be viewed as union busting.

In the hostess case, it can simply fire all 18,500 employees, and slowly
hire them back? And never sign any collective barginnning agreement again?
I know it's almost impossible to hire 18500 employees, but It can shut down
all stores, and start hiring in each community. If it's allowed by law, in
this economic environment, I believe it's doable。 In a couple years, a new
company will be born.
I guess the keything is pension. Hostess already owe too much money to the
pension in the past. Union already almost killed the business.
The lesson is: The business needs to "STRIKE" back early. When you are weak
in a late stage, you have no choice but owrk with the union or file
bankruptcy.
I will never work with the union. When I see a union in my company, I will
not sign any agreements, and force them to go on strike, and I will hire new
employees altogether. 长痛不如短痛。
