the security deposit."
"If the tenant fulfills the lease contract, the security deposit is always
refundable; a tenant can never waive their right to a refund of the security
deposit. However, the landlord can keep part of the deposit if the lease
states that a "redecorating fee" or a "make-ready fee" will be deducted from
the deposit. If the landlord retains all or part of a security deposit, the
landlord is required to give to the tenant a written description and
itemized list of all deductions providing the tenant meets certain
conditions."

Ask apartment management to provide evidence that they have provided you an
itemized list within 30days of your moving-out. If they cannot, they have
to refund all your deposit, by law.
Let them know you will elevate the issue to their higher level management/
file BBB complaint/dispute in small claim court if no resolution, and it may
add incentive for them to work with you.
注意做事方式方法,态度要好,show them you are in control但是也要留人以余地,win-
win situation is the best.

我上期期五去找了manager,manager 说他们送mail给我们了。我说我没有收到。地址
是对的。manager said he has no way to guarantee mailman 100% deliver the
mail to his clients. Then I ask him if they use singature required mail. He
said he didn't.

Next Monday I will argue with manager again. If he still insist, I will go
ahead to sue this apartment.
I will update my information later on. Hope my case can the ppl have such
case in the future. | D******l 发帖数: 359 | 8 Let the manager know that he does not have a case against you. Tell him
that you will make a complaint to his supervisor/area manager/ corporate
office if he won't cancel the collection & refund your security deposit.
Mention BBB & small claim court casually (not to threat or intimidate him).
Also, in a small claim court, usually (not sure about Texas) you can
request compensation for attending court/missing work. Layout everything on
the table, and help him to understand the situation. It will be nice if
you can settle it with the apartment without going to the court. Court
process is no fun at all, to either side.
Avoid face-to-face conversation, and use email instead to leave you some
evidence for trying to resolve the issue, if you sense the manager does not
want to back off.

deposit and partial rent back (month to month, and paid full but moved out
in the middle of the month). to file a claim, you need to find the legal
person you need to sue, and send the signature required notice to him / her.
for my case, it was hard to find that person, but i did research and found
the company's US head quarter and Southwest head quarter, so i faxed my
complain and related documents to them and telling them how much they owe me
, i would sue them if i cannot get the money back, and under the law, i can
claim 3 times of what they owe me.
a week later i got the check in the mail...

company about my case. And give me a non-nigotiate attitude.
Also about move out fee -
He charge me 70.18 rent fee. I pay my rental fee in full. Don't understand
where 70.18 come from, even at that time he is confused by himself.
He charge me cleaning fee 310.00. All items he just charge to upper limit no
matter the condition is.
He charge me carpet cleaning fee 273.56. He says this is what vendor charge
him. That apartment is just 650 SF, no any heavy shampoo and no stain on
carpet. Per Vendor's job estimate, vendor wrote down it would cost 273.56
including tax.
From my point of view, first of all I did not receive mail within 30 days of
