好像IRS改政策了。。3年都在美国的就可以算做resident alien。
To meet the substantial presence test, you must have been physically present
in the United States on at least 31 days during the current year, and 183
days during the 3 year period that includes the current year and the 2 years
immediately before. To satisfy the 183 days requirement, count all of the
days you were present in the current year, and one-third of the days you
were present in the first year before the current year, and one-sixth of the
days you were present in the second year before the current year。

是另一个国家,则依然不是residence alien.
我的岳母去年在这里180天,我也在想就打擦边球申请为resindece alien,他们也不至
于去中国调查你是不是有收入吧?--不过签证的时候貌似还是说了她的收入的。唉,难

般情况,然后列举一堆例外,每个例外还可能有例外中的例外。
比如这个resident alien的判定,如果只看根据lz引的这段话,就会认为只要够了183
天就是resident。但是后面提到F1是例外,就是Ibrahimovic引的那段话。但是如果只
看Ibrahimovic引的那段话,就会认为只要是F1就是non-resident。但是后面又说了只
有F1的前五年才不是。 |
