corruption and served nearly five years in federal prison for extortion and
bribery, will not escape a state sentence, after a San Francisco judge
rejected his request to avoid a year in county jail.
Jew's lawyers argued that he had paid for his crimes by serving 4 1/2 years
in prison camps in Arizona and California, as well as six months in a Los
Angeles jail, on federal extortion charges.
They said he should be given timed-served credits for his separate one-year
state sentence for lying about where he lived when he ran for office in 2006.
A judge on Friday, though, agreed with San Francisco prosecutors, who
insisted that the state and federal convictions stemmed from separate crimes
and that Jew should serve separate punishments.
"If you take full responsibility, you also take full punishment," said San
Francisco Superior Court Judge Kay Tsenin.
Jew, who was freed from prison earlier this year, is scheduled to surrender
and begin his jail sentence April 4.
However, it's possible Jew won't complete his sentence behind bars. His
lawyer, Stuart Hanlon, said the Sheriff's Department may allow him to serve
his time on monitored home detention as a nonviolent offender.
Jew resigned from the board in 2008 and pleaded guilty to federal charges of
extorting $84,000 from the owners of a chain of tapioca drink stores in his
district.
He also admitted to perjury in state court for lying about where he lived
when he ran for supervisor. Jew represented the Sunset District and
maintained a home there, but was actually living in Burlingame with his
family.
On Friday, a thinner Jew - he contracted valley fever and tuberculosis while
in prison, his lawyer said - told the court that he "became acutely aware
of the harm I had done when I lied about my residence."
When he lied, Jew added, he betrayed the people of the Sunset District, the
city, other elected officials and "the general public by showing that yet
another candidate, who promised to be honest, was corrupt."
"I have so many regrets about my actions, but I do not regret being caught,"
he said. "I am grateful that my dishonesty was uncovered so early in my
political career, and that I was stopped before I did more harm to myself or
others. ... What matters the most to me is being with and taking care of my
family."
Jew said that with his political career behind him, he would seek to give
back by "teaching math, preparing adults for their GED tests and helping
them with their resumes and job interview skills," as he did in the prison
