买一个short sale, 今年1月底左右我们递交offer的. 开始我们不知道这个房子有两个
loan. 拖到3月份的时候, 我们的offer终于seller和银行都签字了. seller同意的要求
是要把桌子凳子卖给我们按照3000美元计算. 我们觉得是敲诈但是还是同意了. 加了一
个addendum, 买桌子凳子3000美元.
我们开始办贷款. 突然被告知, 还有一个loan没有approve. 等了快一个月第二个loan
也approve了. 某个文件需要seller签字. seller这个时候又提了新要求, 要住到6月底
. 我们被迫也答应了. 因为seller和第二个loan拖着, 我们interest rate lock还要
花钱做extension. 我们也没办法只能做extension.
一周以前我们agent说要我们把3000块钱cash给他. 他保证seller会签字, 会在6月底之
前搬出去. 不搬出去不会给seller这3000块钱. 他让我们信任他. 我们就相信了. 把
3000块钱给他了. 没有给我们receipt.
终于loan也批了. 一切都批了. 昨天, 我贷款合同也签了. 就等着seller签了就把钱打
过去立
刻close. 结果
今天seller这个时候又提新的要求, 要住到7月底. 我们agent给我们打电话说, "
seller问
他为何要把房子卖给我们? 有人不是愿意出多6万块钱买吗? 所以seller要求住到7月底
.". 我们说不同意. 我们的agent 就多次要求我们cancel contract 来威胁我们. 我
们说我们不会cancel contract. 我么要我们agent先把那3000块钱给我. 他不同意. 说
是我们cancel contract就退给我们. 我们不愿意cancel contract.
后来我们agent又给了一个option是说等这个6月底了,expire了, 重新submit我们offer
. 让7月底close. 但是银行redo appraisal,价格可能会贵很多. 而且我们又要重新走
这一遍程序. 我们当然很不愿意.
请问碰到这种无赖seller怎么办? 还有我们的agent感觉也是一个混蛋.

typical short sale. if you are not an investor, not point of doing this. if

I got the similar problem.
Bank approved letter requires seller move out before closing.
Title company cashed my initial deposit.
But now seller refused to move out and sign off.
The agent (dual) asked seller either to sign or to cancel by Monday.

push to close this time。
如果重新submit offer,让7月底close. 银行很有可能涨价。
我有一个客人最近的case,银行offer price签了,loan也弄好了。tenant 本来同意搬
走的,后来一拖再拖,还把owner告上法庭,等court order他搬走时,银行取消了原来
的合同,说等得太久,市场已经变了。要重新涨价,重新review offer。。。

My seller likes exactly what you said:
破产, nothing to lose。不成正好再免费多住一段时间。
Seller said he would sell the home to me if I rent the home to him.
But the bank approval letter said that the seller must move out.
I would be in potential criminal if I rent the home to him, without bank's
agreement.
So no deal (solution) for this short sale!

所以现在弄short sale,纯粹是浪费时间。
银行没有motivation close因为expect房价会涨,
owner也没有motivation close,因为close了对他
也没有啥好处,不close反而能免费住。
所以两边都会变着法子找麻烦。除非您老彻底投降,
答应所有条件,完全合作。
有时候加上这些extra的东西还是比市场价低,那就
还是值得做下去。

我买过一个short sale 屋主也有点磨撑 最后close虽然 签字了 但要求租一个月 我们
反复思考后决定让他租回一个月 但是eviction的准备也做好了 丑话说在了前头 最后
顺利搬出 屋主不是没有忌讳的 关键 看谁硬
如果他被evict 可能出去租房都租不到
如果不签close paper 不用太怕 你有没有contract? 是标准的吗?你现在需要找个 律
师看看

My sellers want to stay!
Now, bank will give them $3000 relocation fee if they move out before close!
otherwise, no $3000.
Before they took my offer, I orally agreed to rent home back to them.
But now bank requires seller must move out to have $3000.
I guess your case might be out of date.

You can't tell the bank you will rent to him now the bank knows you have no
option
But you have contract and he signed he is breaching a formal sale contract
Never sign release paper in this case! The longer he stays after the close
date the more damage you can sue
You guys might have never realized the real estate contract heavily lean
toward the buyer and make sure the seller can not easily back out. Don't
take my words for it consult a real estate attorney
You will find out how much power you have as a buyer!

You said bank already approved and seller signed contract
The only problem is the rent back as the bank will have financing issue with
you
That's it. So don't rent then or rent to him under the table and take the
risk of loan fraud
If you decide not to rent to him and he still stays after close
You need to sue the seller for specific performance to get the house
In most cases a lawyer's letter is good enough and the same time ask the
agency's broker to see what is the issue with your agent they should have
sent a letter and threat to sue for lost commission
The owner destroy the house after he signed to sell? Too bad you are not the
bank Warn him for the legal consequence
And the listing agent become partially responsible too after the damage
In your case every one has a financial reason to be on your side you have to
use them all

me to sign with no reason.

Right, 现在你要做的就是进去缴和。 让他卖不出去。 年初碰到一个类似的 case, 还
好我们 walk-away了。 最好的办法就是sue the seller. 这个房子有法律纠纷, 买主
都不会碰。 因为法律纠纷不解决, 房子close不了。
赫赫,这叫以其人之术还其人之身。

I closed a short sale house. There is a section 8 tenant in there. Seller
agent gaved 90-day notice of termination, which suppose to move out by end
of this month.
Tenant suppose to pay the rent for this month. But i haven't receive the
rent. I plan to give a 3-day notice to pay or quit.
Can you tell more about how to prepare eviction? I need to prepare too if
they dont move.

don't sign anything. consult a lawyer to send a letter. consult your agent
too. who is the new listing agent? warn the listing agent about the
potential law suit. If the seller doesn't back down, the lawyer can file lis
pendens so lawsuit pending will show up in the title search. He won't be
able to sell that easily.

section 8 is not that easy in terms of eviction. Did you talk the tenant?
there is no incentive for them to short the rent because the city cover most
of the rents for them. first of all, you need to talk to your tenant and
his section 8 program coordinator in the government. (this should have
happened once
you closed the deal.) File the owner change form. Then the government will
transfer the rent to you. That's all. If you don't like him, then you have
to send 90 day notice to both government and the owner. If the tenant doesn'
t pay his portion of the rent he may lose the section 8 eligibility. So talk
to the tenant kindly, and more importantly his program coordinator. you may
want to keep him at least for the short term.

sue the seller to get house. That's all for the special performance. The
court will force the deal to close. Even if you want to sue for the
financial damage instead of getting the house, the seller is still at risk.
Even if he declared the bankruptcy already, any debt incurs after the
bankruptcy doesn't cancel automatically. The court may force wage
garnishment (you think the employer will be happy if his boss knows the
employee needs to pay 25% after losing such kind of the lawsuit), or the
court can ask sheriff to seize bank accounts. Nobody wants to live that kind
of life even the bad people...

What I found out is that the program worker doesn't do much. I tried couple
of times to get the record updated. They don't care regarding. The
government pays half and tenant pays half.
The deal already closed. now I just want to move in. I will send a 3 day
notice anyway just in case.

房客要是想再多住一个月,你就干脆再送他一,二个月的租金,让他按原来的日期搬家
。如果房子值得买的话。
你不应该无缘无故先给cash出去,所有钱银过手都应该通过title company完成吧。

我反复说了,你要咨询律师。我说什么也不算啊。去你local的bar association,问图
书馆律师免费咨询服务,然后要他们给你refer。也有可能有人做打赢官司才收钱的。
叫pro bono。一般收费的也就$300/hr。总之,你这个一定要律师信,人家就是欺负你没
有律师信。

你如果搞不通政府这一关,很难evict。找hud case worker面谈。不行就escalate。否
则上法庭你得把政府给告了。因为他其实也是你的tenant。

Just talked with an attorney. He wanted to take the case to file lawsuit
immediately. But He charges $5000 to start.
He said he can force the sale to me.
What if I got the house but it might be damaged by seller.
Tomorrow, I will talk another one to see if I can get a letter first ..

自己不认识的话 bill hour 比较好 比如他读一封邮件 100块 给你准备封律师信300块
什么的 很多时候人一看你玩真的 就萎了 根本不用打官司 你这个case 随便街上拉个
律师也能赢 属于律师要抢的生意 别给烂律师糊住了

只要buyer不签cancell the contract, seller 就不能卖这个房子。 我朋友干过这
种事, 不签cancell the contract, 就有个lien在房子上, 那这个房子就不能再
short sale, 除非forclosure。 那seller的credit 7年不能修复。

I will not sign it for sure. I did not know it is called a lien 在房子上.
But my attorney did say that "那这个房子就不能再 short sale, 除非
foreclosure" even after bank approval letter expires.
Did your friend get deposit back after foreclosure? Thanks.

she did not get the deposit back. The agent told her to sign the
cancellation, she refused. the agent said that otherwise she will not get
the deposit back, my friend did not care about the deposit. The wenxuecity
people told her not sign cancellation, then the house could not put on
market for short sale again, the bank had to forclosure it, the seller did
not want that happen.
so the house can not sell again. the agent wait a while, no one would give
up. at last the agent have work with the bank, seller and buyer, refile the
paper, my friend got the house at last. The agent was pretty good, he had
network in the bank, and he offered some benefit to the seller.
It took 8 months to finish all.

Interesting story and glad your friend got the house at the end. Thanks for
sharing. My case is different: the agent is not helpful at all. This is why
I need a attorney.
My attorney said nobody can take my deposit and it will be always in title
company. I will get it back after foreclosure.

靠,Sellers 真是死猪不怕开水烫了.
Attorney letter required sellers to response by Yesterday, but no response.
Sellers breached sell agreement without any reason. Bank approval will be
expired next Friday.
Tnnd, 真是没招了.
