long story short
My wife manager is 越南女的
My wife manager gave her a low rate on last year review.
my wife gave her manager a low rate on last year review in return.
2 months ago, her manager assigned tasks to her that was impossible to
complete. My
wife communicate vs email with her manager asked for more time. I don't
know what her manager response in the email. My wife forwarded the email to
her personal account as a record that might be needed in the future.
Yesterday, her manger told my wife that she failed to deliver and should
resign. My wife was anger, and told me that she was going to start a legal
fight.
Today, her manager started a 心理战,told my wife she has to go to work on
time, and report daily status. After the meeting, my wife 心理大失一段, 斗志
全失, determind to resign next week.
It is understandable that my wife 心理大失一段, 斗志
全失, determind to resign next week.
It extremely hard for an employee try to keep a fight with a manager.
Because
the manager has power over the employee.
My suggestions.
1. Resign next week
2. take a break
3. ask labour lawyer to evaluate the case after the break.
4 make the decision about the actions to take.
Are there better options?
[sick leave] is a better option!(suggested by Ogden)

不用resign。 公司不敢轻易解雇,没有good documentation, 员工可以告wrongful
termination. 一般公司赶人走还要付封口费的

先sick leave3个月,不干活。整死那manager
我这也有个偶尔冒出中文,平时就怕别人知道她是中国人的一个manager, 对手下mean
的不行。一听手下可能要去hr,居然咆哮,象文革一样要批斗。还说过去去过hr的人都
没有好下场。
我刚好witness一切,直接告知伊老板此女需要去management training, anger
management class。 否则不qualify。

If your wife wants to fight, then she will need to start make documentation
for all the manager's mismanagement in writing (even the little things).
That way, when the time comes, at least you have doc. to prove you are being
discriminated. I'm sure the manager is currently gathering all evidence
against your wife as well, i.e. paperwork showing work inefficiency, so she
also need to prepare to keep documentation regarding that, if the work is
impossible to finish, write email to inform the boss to keep record, maybe
even jump the chain of command, and go above the direct report manager? If
the boss wants daily report, make the report in writing, also in report
write why it is impossible to do the job without proper support or tool or
time, etc. Also hire a lawyer if she really wants to fight.

Thank you for the suggestions.
wife worked on two tasks , and worked very hard.
1. web site development. She completed the task two weeks ago. She emailed
the
code to a white software engineer who should check in the code. My wife
talked to the enginner Friday(10/16/2015) about the status of the project
and if She caused delay, the engineer said my wife did not caused delay, and
he has checked in the code and he is excited to learn the technogy that my
wife used. M y wife sent an email to comfirm the status. Her manager saw the
email, and got an project manager to over-write the engineer statement. The
project manager and the manager talked to my wife in person. The project
manager said my wife caused delay, and the code was not checked in by 1pm
Friday. my Wife tried to argue. The project manager said You did not
understand, and I repeat one more time.
My wife responsed "I understand what you want to do, you do not need to
repeat."
2. QA automation tool development -- have a couple days of delay, my wife
demo
the project Thurday(10/15/2015).
My conclusion. It is mission impossible to prove that she completed a task.
I think her manager strategic goal -- Caused my wife suffer psychological
pain to force her to resign.
I have two plans
plan 1. strategic goal. -- Stay in put, don't resign, find ways to avoid
seeing the manager.

这种情况,这种关系,如果忍了,以后也会很难过的吧,听起来你太太现在已经很难受

We don't mind that she lost job.
We know the fight could be

our strategy is to show she put up resistances.
Her managers wanted her to report status daily. She refused to do that. At
the mean time, She is going to take sick days to see doctors. She is going
to
get doctor note to take sick leave.
It is in a 心理战 phrase.
She refused to take her hostile manager order, the Next step is a potential
legal battle. We think that will put some pressure on her manager.

Thank you for your encourage.
My wife prepared, and documented the evidents. However, we feel those
prepare is 不堪一击. because the manage has power. Her manager 颠倒黒白.
We must adjust the way to fight. and fight in a front that shows her
manager is not in full control.
The first step it to show my wife is able to refuse to take her manager
order.

老大,情商啊!你们都工作几十年了,这种斗争其实很有意思的。首先要镇定,谁先搂
不住火,谁就输。看你说的,你老婆的老板十有八九是刚混上最底层manager,斗争经
验也不足,你还是有很好机会的。每天汇报工作进展是非常合理的要求,你不能拒绝。
可你能bulls*it啊。对于老油条最基本的一点就是一天啥也没干,可是讲给别人听可以
讲的简直8小时都不够用。分配工作时,觉得干不了,一开始就要讨价还价,说干不了
。不能当时不敢吭声,事后加班加点,那都是活该。大公司开人没那么容易,不要主动
辞职。干了几年的人,performance不好不是开人的好理由。现在也都没到请病假的时
候,先斗争一段时间再说。不过要看你老婆有没有那个情商和斗志。人到中年,只会低
头干活是不行的。好在你们有经济基础,底气不应该那么不足啊。

老大,你和老婆这都是什么决策嘛。千万不要resign! 你被要求resign,然后真的自己
resign了,那个manager和employer睡觉都要笑醒,正中人家下怀。自己主动resign =
对方没有错,你自己都认了。
正确的第一步:找下家。就算打官司赢了你还指望继续在这里干下去?
第二步:找HR。拿着manager要你resign的信去问问怎么回事,有什么option,有什么
package,绝不要拍拍手就走。公司让你走都是请走的,要fire也好要layoff也好得有
个说法,你找工作下家的时候也好给一个交代。
第三步:找labor lawyer。不多说,只不过如果想"fight",请你们俩找专业的先咨询
一下在做动作,否则以你们这点功力,不给自己坏事就不错了,更别提打赢了(到底有
没有discrimination,到底你有没有damage)。

老大,你走到现在这一步比较难弄了,你们又没有斗争经验估计弄不到什么。一个选择

Then do not fight it. Show some good will by showing up (after using
vacation and legit sick days of course) and work as normal.
If you talk to HR nicely you might get some package. If you fight and just
flat out refuse to work, guaranteed you will get nothing.

That is a good suggestion.
My wife emailed HR today to raise the issue. She took a sick day today.
We consider bringing in HR as needed step to bring a labor lawyer in next if
it is a good option.

I would think, if new group has opening, she could communicate to new
manager if remote working is fine and apply for the position, then take an
interview. once new group
accepts, she will have a transition period to transfer work. it is strange
to me that new group wants to see her real performance by taking 2 jobs at
the same time?
I really don't think she should take 2 jobs at the same time...

The fight is not about money.
It is about if we are able to fight back when we get unfair treatments.
My wife co-worker(+friend) recommend that my wife not to confront her
manager, accept all her manager's requirements, just find a new job.
We choice to fight back since we have done a lot of defensive measurements.

My wife presented the case to HR today. The HR person sounds very nice.
I don't know if it is only 表面现象.
The real test will come Friday. I expect HR will present a solution Friday.
My assessment of the case. major factors HR will consider when they present
a solution.
1. My wife manager and HR know we don't care about to lost the job.
2. If my wife manager back down, her reputation will be damaged. We don't
know how powerful and important my wife manager is.
3. If my wife manager do not back down, that might lead to a legal battle--
that means HR does not do their job well. We do not know how strong our
evidence are from legal viewpoint.
4.If HR is able to reach a compromised solution- that mean they do a great
job.

Round 2 -- today fight update.
HR and my wife manager was surprised by the way we fight.
1 我们开辟新战场 -- fighting Workplace bullying. Not fighting about the
performance review issues. After reading my wife email complaining about
Workplace bullying, HR person had to say if they said that, that was
unprofessional. performance review issues is not big enough for a legal
battle.Workplace bullying is.
2. 不能拿工作威胁. My wife manager think my wife will beg her for the job.
That is not the case.
My wife told HR that the reason that she stays in the position is her
manager give her flexible work hours, and promise to let her lead a team.
At the mean time, We are able to fight in an even field.

Your wife showed up at HR to "fight" on a sick day? Bad move. How could the
employer trust you?
Call in sick with such empty email with no detailed excuse is another bad
move. Extremely unprofessional. If the employer finds out you faked on sick
day and were actually refusing to work intentionally, your career here is
over and no lawyer can help you.
That's why I said talk t a lawyer before any moves. You obviously didn't
listen as the lawyer will tell you to stop posting in public if you are
prepared to fight. You also need to show goodwill by showing up everyday and
work reasonable hours - if the bad manager has unreasonable demands, you
don't have to follow but you still need t at least work the same hour as a
reasonable manager would expect you to. If you just outright stop working
while the company is still paying you, no judge will be on your side. So
talk to a lawyer first.

I get some excellent ideas for how to fight from this forum and people sent
private email to me.
One can fight even suffering [Emotional distress].
sick out for [Emotional distress] -- not total disabled. It is real, not a
fake. It is backed up by medical records.
I drove her to work place today to present the case.Full of energy and very
sharp when present the case.
I think It is reasonable. [Emotional distress] -- unable to work, but is
able to present the case. HR person said if what my wife wrote is true,
then the problem need to be fixed. We will see if her manager and her
associate dared to deny what they have said last Friday. We have a
reasonable way to show that their denies are lie.
We will not fight that way -- going back to work without resolving bullying
issue.
My wife will not go to work if the bullying problem is not resolved.
We don't want to go for a legal battle if HR can resolve the problem. We
want to give them time to do their job. We still have faith in company HR.
We expect HR will present a solution Friday. We will determine our next
move based on HR solution.

I think my posts in public forum -- rewards out weight risks .Because our
fight is facts(evidence) based. We are fighting by presenting facts to HR.
my wife manager also told her side story.My wife found her manager
forwarded old email to HR. We think the emails will make damage to her
manager rather than help her. e.g.
In one email her manager said my wife is strong in technical, however she
had communication problem. [communication problem] is a major excuse her
manager often use to against my wife. After presenting the facts to HR
person, the person said my wife communicate well, she does not see [
communication problem].

The end game -- flight
HR showed off power today-- They can do what they want to do.
They presented a settlement yesterday.
HR withdrew the settlement after my wife emailed them that She accepted the
settlement this morning.
Our choice: flight. Regroup late to see if legal battle is a good option.
