HAMPTON — A former employee of a NASA Langley Research Center contractor
was sitting on a Chinese-bound plane at Dulles International Airport on
Saturday when federal agents came on board and asked to have a word with him.
Federal prosecutors are now accusing that man, Bo Jiang, of lying to those
federal investigators about what he had in his possession.
Just last week, the FBI had opened an active investigation into whether
Jiang, a Chinese national, might have violated the federal Arms Export
Control Act, according to an FBI affidavit. But on Friday, agents learned
that Jiang "was leaving the United States to abruptly return to China on a
one-way ticket," according to the affidavit.
On Saturday, Jiang flew from Norfolk International Airport to Dulles, where
he was planning to fly to Beijing, the affidavit said. But while he was
sitting on the plane as it readied for takeoff from the Northern Virginia
airport, federal agents came on board to search Jiang and his possessions.
During the "border stop," which the FBI affidavit describes as "consensual,"
agents asked Jiang what computers and computer storage disks he had with
him.
"Jiang told the Homeland Security Agent that he had a cellphone, a memory
stick, an external hard drive and a new computer," FBI Special Agent Rhonda
A. Squizzero wrote in the affidavit for the arrest warrant. "However, during
the search, other media items were located that Jiang did not reveal. Such
items found include an additional laptop, an old hard drive and a SIM card."
It was unclear from the affidavit what was found on the additional laptop,
hard drive and memory card — and whether or not it had any sensitive
information contained on it.
"Your affidavit believes this to be material to the federal investigation,
in that it was important to learn what electronic media Jiang was taking out
of the United States," Squizzero wrote. "Your affiant is aware that Jiang
previously left the United States and traveled to China with a laptop
belonging NASA (sic) which your affiant believes contained sensitive
information."
Jiang faces a federal charge of lying to investigator — specifically, he's
charged with "knowingly and willfully making and causing to be made false,
fictitious and fraudulent material statements and representations, and to
falsify, by trick, scheme, and device a material fact."
He will be arraigned at 4 p.m. in U.S. District Court in Norfolk.
According to a report in the Washington Examiner last week, U.S. Rep. Frank
Wolf, R-McLean, identified Jiang at a congressional oversight hearing, with
Examiner quoting Wolf as telling the committee that Jiang took "voluminous
documents" home to China.
The source of Wolf's information wasn't clear from the article. Wolf is the
chairman of the House Commerce-Justice-Science Appropriations Subcommittee,
the arm of the House Appropriations Committee that funds NASA.
The Examiner's Richard Pollock reported that Jiang worked at the National
Institute of Aerospace in Hampton, a research institute and non-profit NASA
contractor. The article quotes NASA inspector-general Paul Martin as saying
that Jiang had "unescorted access" to the NASA facility, and quotes Wolf
saying Jiang was allowed to "roam at will."
Wolf said last week that "several dozen" Chinese nationals were employed by
the contractor in a "work-around" of hiring restrictions, which he said
could compromise national security.
Wolf claims that NASA intentionally uses the National Institute of Aerospace
and other contractors to circumvent a law he sponsored in 2011 that "bars
NASA from hiring Chinese nationals to work directly for the agency," the
Examiner article said.
NASA headquarters spokesman David Weaver said last week that the worker is
no longer at Langley, and that NASA contractors must comply with all U.S.
Export Control and immigration laws. He said the matter was reviewed and
turned over to the appropriate law enforcement agencies.
