On the morning of February 12, 2008, 14-year-old Brandon McInerney
carried a loaded gun into the computer lab at E.O. Green Junior High School
in Oxnard, CA. There, surrounded by 24 other students, he shot 15-year-old
Lawrence King twice in the back of the head, then immediately ran from the
building. At the time, Newsweek called the murder “the most prominent gay-
bias crime since the 1998 murder of Matthew Shepard.”
McInerney, now 17-years-old, pleaded guilty Monday to second-degree
murder as well as one count each of voluntary manslaughter and use of a
firearm in a plea deal that carries a mandatory 21-year prison sentence, but
avoids retrial. The decision comes almost two months after Superior Court
Judge, Charles Campell, declared the case a mistrial back in September of
this year:
" Ventura County, Calif., Superior Court judge Charles Campbell declared
a mistrial in the two-month-long case against the 17-year-old after a jury
was unable to decide between charges of first-degree murder with a hate-
crime enhancement or voluntary manslaughter. The former charge would have
netted McInerney at least 53 years in prison, the latter only about 20. "
Prosecutors argued the killing was motivated by McInerney’s homophobia
and ties to white supremacist ideology. The defense argued King had made
unwanted sexual advances that caused McInerney, in a fit of rage, to suffer
an emotional breakdown.
McInerney will be officially sentenced December 19.

In this case, it seems the answer is yes.
