开始时间是在二月1日，这样的话中间就有十几天的gap , 我想请问一下这影不影响我
在美国的身份?
另外前段时间因为老板很突然提出终止合同，我担心一时找不到下家失去身份，因为LD
是H1 所以就申请了H4 ，现在H4还没有批准，而且也不知道能不能够批准，不知道我现
在能否撤销H4的申请?

发帖数: 427 | 3 多谢回复，我没有申请waiver,因为我是从第三国签过来的，签证上写着 not subject
to 212 bala bala ,所以就直接申请H4了，当时也只当权宜之计，不管批准不批准先申
请了再说。 |

gap 有什么影响，J1 的grace peroid 是一个月，在这一个月内不知可否进行J1
transfer。另外我知道有些在国内过来的，比DS2019上的时间提前过来的，好像也没有
什么问题。 |

发帖数: 526 | 7 原则上，J1 transfer中间是不能有gap的，一天都不行。不过如果你没有回国服务的限
制就不知道了。问问你新的老板能不能把合同提前半个月了，我觉得半个月应该没有问
题，就告诉他你要做J1 transfer，中间不能有gap.

发帖数: 437 | 8 J1结束后，还有30天的grace period，可以合法留在美国，但是不能工作，所以我觉得
原则上你可以利用这30天。 |

发帖数: 526 | 9 这30天是不能利用的。我做过transfer，当时问过HR的人。这30天是让你收拾行李走人
的，不能用来做transfer。

A J-1 student in good standing may request to transfer from one educational
institution to another as long as the transfer is to complete the same
educational objective for which he or she was admitted to as a J-1 student.
A transfer is processed through updates to the J-1 student's SEVIS record
performed by both the current school and the new school. A J-1 student who
intends to transfer from one educational institution to another should
discuss his or her plans with the Responsible Officer (RO)/Alternate
Responsible Officer (ARO) of both schools, provide official evidence of
academic admission at the new school, and decide on a specific date of
transfer. Since J-1 students are admitted for "duration of status" (D/S),
which is defined as the period indicated in item #3 of Form DS-2019, plus a
30-day grace period following the program end date, all transfer requests
should be made no later than the end of the 30 day grace period.
J-1 Grace Period
A J-1 student who has completed a course of study including any authorized
Academic Training following completion of studies is given an additional 30-
day grace period for departing the United States, applying to the United
States Citizenship and Immigration Services (USCIS) to change J-1 status to
another status if he or she is not subject to the two-year home country
residence requirement, or transferring to another educational institution. |
