我们找Peter Fang(中文音Yulin, License No: RS290201) 作buyer agent半年(实际
只有几个月因为中间停了三个月),最后因为他的失误我们损失$5000押金和$840律师费,
大家不欢而散.
首先是不带任何感情色彩地事实描述。事情经过是这样的:
May 18 我们看了4个房子
May 21 我们出了一个offer,$450,000 (asking$460,000)押金$10,000,10天home
inspection contegency
May 22 seller counter offer $455,000. 我们想再看一下,毕竟那天看了4个房子,很
多细节没注意.peter说先签字把房子hold住(他的原话)再看,反正押金肯定可以要回来.
我们签字
May 23 我们又看了这个房子,又商量了好久
May 24 我们通知peter我们决定退出.peter不太高兴但说他会和seller说。peter发
email给seller agent通知说我们要退出
May 26 房子从新放回到redfin.com
May 28 我们签了the agreement of sale release
May 29 seller agent发email回给peter说seller不愿意退出.peter没有告诉我们也没
有forward email给我们。
Jun 1 在10天home inspection contingency过的那天,peter告诉我们seller不愿意退
出,但还是安慰我们说只是时间问题,seller应该最终会签字同意退押金.
Jun 6 peter告诉我们押金可能拿不回来
最终我们自己找了律师要回一半押金,损失五千外加$840律师费
我们觉得peter应该负主要责任,理由如下:
1.不专业装专业。peter从来都告诉我们只要十天内退出就可以把押金拿回来。有一次
信势旦旦的讲什么以前是不行的,后来宾州通过一条法律专门来保护buyer,所以有个10
天的grace period 让buyer想清楚。后来我们问了律师才知道根本就没有这一条
2.每次都让我们多放押金($10,000).说宾州都是这样。后来我们换了agent,每次押金只
让我们放$1000.我们问了别人,也都说$10,000押金太多了,让seller觉得值得为了押金
和我们耗。以前还放过3万,幸亏没出什么事。
3.seller通知说不愿意退出时,我们还是有时间做home inspection安全地退出的,可是
被peter耽误了. 至今我仍不清楚他为什么把这个消息压了4天,直到contingency过了才
告诉我们。Jun 6以前他一直和我们打保票说押金可以拿回来.
4.Jun 6以后peter说会负责帮我们要回押金,但除了推荐了一个律师,以及和他的broker
谈过几次外,他什么都没做。最后连人都找不到了。最终我们请的另一个律师,我们自己
处理了所有的事.
5.另外我后来找人看了我们签的合约。Peter 放弃了所有可能保护我们安全退出的条款
,例如appraisal contingency,贷款条款
事后我们和他联系,他承认他的失误,但不肯负任何责任,说五千多算是他带我们看房
的补偿。好吧,那就看看他是怎样带我们看房的。几乎所有房子都是我们找的(他发的
基本都是七天以上的),他做的只有拿钥匙开门。他对我买房子的区不熟悉,基本没法
给我们任何建议。问他就说让我自己查。说过几次基本都是错的(例如说greatvalley
district 只有两个小学)。他兼职做房产经纪,还有一份正式工作,房子抢的时候没
法weekday看。让他和selle agent 问个问题不知为什么会这么难,坚持不肯打电话,
我有几次不耐烦问他要seller agent的电话,他不给说是不合适。最让我受不了的是看
到每个房子都说好,一进门就说这好那好。隐瞒房子缺陷,有一次我们都下了offer,
朋友说房型不好,以后不好卖(我们刚搬过来,对这里不熟悉),我们紧急退出。问他
他说是不好,但不是还有人住嘛。要不是有合同,我早就要换人。另外合同也是他说宾
州必须签才签的,后来发现很多朋友都没有签。可气的是我事后仔细看才发现他当初把
buyer agent合同夹在agreement of sale中间让我们签字。也就是scan过来的PDF 中间
夹带的,前面和后面都是agreement of sale。
教训:
1。不要过分相信agent的话。很多agent不靠谱
2。觉得agent不好就及时换。我们其实早就觉得不满意,但是觉得peter带我们看了不
少房子,也写了几个offer,就。。。
3。合同还是要仔细读,不清楚的最好问房产律师。peter出问题后自己承认这方面法律
不清楚。
现在打算上小型法庭,不管胜算多大。另外也会向real estate license Board report
,不能让他再祸害别人。在这里向有过小型法庭经验的朋友咨询过程和注意事项,谢过

you hire an agent. and agent works for you!
people really need to take this fact INTO heart:
if the agent did a terrible job, it reflects pretty BAD of the one who HIRES
the agent.
Because the principal is the BOSS, the agent is a servant.
I can understand a servant complaining about boss.
for bosses keep complaining about servants, it's just laughable.
think about it.

and in this particular case, it's entirely USELESS to post in NJ.
PA has different Real Estate laws. nothing said here will help NJ buyers or
sellers here.
Speaking of Pennsylvania,
On a separate and unrelated note, Did you know there is a place in PA,
called Intercourse?
teenagers there must be more 早熟 than usual. they can hardly escape the
question.

A little confused. if you sign a contract, it is not valid till at least 3
days after the attorney review. So if you verbally or in writing communicate
that you want to withdraw, you should be fine. I suggest you go to the
court of the township where this property is located and sue your agent's
broker for lack of due diligence and care. I think you have a case. As an
agent, if we get sued, the broker will pay the fine because we pay insurance
. sorry to hear your story...

The you still should be able to sue. That is kind of agent that ruin the
whole soup. If you sue your agent and broke successfully, then you can sue
your attorney too because he only get half your deposit back.
I have never had such a case happened. I have a client who withdraw from a
contract after inspection, but the seller refuse to sign the deposit release
form. I prepared the paper work for my buyer to sue seller in the Monmouth
court in freehold. Though the seller argue that they were not aware of our
request to sign the release form, but they agree to sign in the court, and
the judge let them go that way. The deposit is on the way to my buyer. It
takes about 6 months to get it resolved.

I see. but you want to withdraw during attorney review period, which is
legal in NJ, but might not be in PA. In PA, attorney review is not required.
Can I ask that if your agent prepared the contract for you or an attorney
prepared the contract for you?
