老公在外州1工作时候，回NJ住，然后换到外州2工作，因旅途遥远，就不回来住了。。。

1. To do it correctly, your husband and you need to file both State's tax.
To "file" does not mean to "pay", it is just extra paper work. 1 State's tax
will credit to another State.
Well... If you have no income, no house mortgage, no bank account with
address in NJ, who the hell knew you lived in NJ. You can say you lived with
your husband in another State. But if you are going to claim something
happened in NJ, you should file NJ tax as well, no point for saving some
paper work and risk of getting into trouble.
2. Tuition and Child Care may be able to claim credit in Income tax.
