我used 4种方式给我的客户回扣
1:双方谈好价格以后,seller further reduces the agreed price by the rebate
money and then subtract the rebate money from my commission. This is the
easiest way and nobody needs to pay tax and won't show on HUD . But the
seller and other agent have to agree , it won't work for relocation company.
2: 回扣直接写进合同。this rebate money will show as a credit from buyer
agent in the HUD. It has to be agreed by the seller, title company and the
lender. Since buyer agent rebate is a new thing, not many title companies or
lenders know. I have to explain to them how, and debate with them it is
legal.
3: 我的broker直接以公司的名仪给buyer一张check, 和1099 form. Sorry you have
to pay tax on this. The total commission will be an income to my broker and
somebody has to pay tax for it. My broker is still studying the law and try
to find how nobody needs to pay tax for the rebate. In this this way, you
must sign the buyer agent contract with me, the rebate will be written in
the contract.
4: 我给你写一张支票 or a gift card. It depends on the mount, I may give you
a 1099 form or just pay the tax for you. This needs nobody's agreement but
me. But I have to give 50% of the commission to my broker, the rebate I can
offer will be very limited in this way.

broker, buyer broker, buyer) are pushing harder for profit margin, the 4th
option might be the most likely case. I understand it is legal to ask for
rebate and it is good for buyers. I have no problem with that. The problem
I have is the passing of legalizing rebate program in the last few days of
Corzine administration, while still keeping a rigid broker-agent
relationship law in NJ. In New Jersey, agents need to work full-time for 3
year to be eligible to get a broker license. With this law, it is already
hard for a new agent like you to make a living while working full-time for
three years,and this new rebate program just make it harder. Wish you a

可是现在是网络世界,如果你不给rebate,别人可以照样找到房子,完全可以不需要要
agent就可以买房,buyer agent的作用慢慢地会越来越被网络代替,地产律师把把关就
可以了。别的州有redfin,他们的生意愈来愈好,就是应为他们给一半rebate。
完全理解你的担忧,一般agent要给broker多少钱啊?

Broker usually rip off less more experienced agents who bring a lot of
business to the brokerage. New agents usually get 50 to 60 percent of the
commission (maybe 50% of 3%). If buyers do not care about dual agency, they
can have seller agents represent them. Some brokerage like remax may charge
less proportion of commission to agents, but they provide less support to
agents too.

I total agree with you. You can find anything you want on line about the
house that you are interested in. The only thing you cannot do is put in an
offer yourself. However, if you work with a rebate agent and you will get
reward for finding the house yourself. I know client who is in the market
looking for a house for 2 years. They have seen every house were in the
market at their price range. They had gone to almost all the open house.
If you are smart buyer do the homework yourself, and get pay for the work
you had done. Your rebate agent also can provide you with the information
you need for house searching.
Does not matter which choice you pick, get something back is better than
nothing.
The split between agent and their broker is depending on the employment
agree. If you are a new agent, most likely you will start with 50/50 split
with your broker.
Lot of times big name brokers do not like to give buyer's rebates. They
have to keep their profit margin in a target percentage. Working for a
discount broker firm, your broker will have less control how much rebate you
are going to give to your clients.
How to pick a agent?
A good agent love their job and enjoy what they do every day.
For a new agent, broker in the firm will help with her/he deals until they
are good on their own. Most of the time, they will get a mentor. A new
agent may not be a bad idea after all, you pay one price for 2 people to
help you. Sometime is better than an experience agents who only look at how
big their commission check will be.

Yes. You don't need to pay tax only if it is equal to decreasing the price,
and agreed by all the parties. Methods 3 and 4 are almost like outside the
transaction, and can not be consider like decreasing the price.
I hope there is new document, while agents/brokers file their tax, the
rebate money could be listed for tax reduction. The law did not cover this
for now.
