Last month, Facebook — which owns Instagram — offered $650 million to
settle a similar lawsuit alleging that Facebook's photo-tagging collected
biometric data without users' consent.
Under the law, Facebook could be faced to pay up to $5,000 per violation for
as many as 100 million Instagram users, totalling half a trillion dollars
at most.
A Facebook spokesperson called the suit "baseless" and said Instagram does
not use facial recognition.
