标 题: 关于党员+485的一些基本事实 [已建微信群，见67楼]

最近版上和隔壁版上出现了一些关于CP党员 485 RFE的帖子，弄得人心惶惶。本人也是
其中之一，自己的case很类似，甚至更为严重（CP membership终止才2年3个月，提交
485时刚满2年，主申请人，TSC）。所以把自己所知道的写出来，希望能和大家讨论一
下，争取能阐述清楚一些事实，形成大家进一步讨论的基础，最好能集合大家的力量能
为“党员+ 485”问题提出一个妥善的应对方案。只针对问题进行探讨，谢绝各种人身
攻击！

以下陈述如果有误，请各位指出。
1. 党员和485 pending时间
党员和485 pending时间长短没有必然联系，根据本人考古的结果，Mitbss上也有不少
党员485 3-4个月获批的case，但5年以上还是大于2小于5，具体哪种情况多不清楚。也
有党员pending时间大于1年以上或更长的。
2. Yes or No
485党员问题，版上有两种意见：（1）直接填No，（2）填Yes，附上statement，
根据最反馈的关于党员的RFE，IO指出statement是模板，应当根据自己的情况，重
新撰写statement，模板似乎更容易招致RFE。
3. 党员问题的裁决过程
根据法律原文9 FAM 40.34 NOTES，每个IO都拥有独立的裁决权，裁决过程如下：
（1）申请人是否曾经是党员
（2）如果曾经是党员，进一步审查是否满足年限要求，党籍终结的时间至少在：(i)
该申请日期的两年前，或者(ii) 该申请日期的五年前，如果该外国人曾为某个独裁极
权政府的执政党党员；
（3）如果申请人不满足年限要求，需要进一步审查其党员身份是否是无意义的，或者
非自愿的，或者为美国公民的直系亲属，满足豁免要求。
所以，党籍终止在5年前的一般不用担心什么了，如果终止在5年内，只有声明党员身份
是无意义的，非自愿的，或者美国公民的直系亲属
4. 不满足5年怎么办？
党籍终止不满5年的，孩子也是在中国国内生的，就只能claim无意义或非自愿。
无意义不是一个法律的明文规定，但是一个司法上创立的一个概念。主要有以下几个可
引述的理由：（这里只列出几个常见的，比较冷门的可以去参见法律原文）
（1）加入的动机没有任何政治含义。Membership was not present when the
dominating impulse to the affiliation was wholly devoid of any political
implications.
（2）不知晓其政治组织的本质membership was not present if the alien, during
the association with the proscribed organization, was not aware of its
nature as a political organization.
（3）加入是偶然的，人为的，无意思的或者是表面上的。Membership is not present
if it is proven that the alien joined accidentally, artificially, or
unconsciously, or in appearance only.
（4）加入其附属组织时，不知道其与政党组织的依附关系。 Membership is not
present if it is established that the alien joined an affiliate of the
Communist Party, or a subdivision thereof, when the alien had no knowledge
of the relationship of the affiliate to the Communist Party or its
subdivisions.
非自愿，Solely for the purpose of obtaining employment, food rations, or
other essentials of living。希望能在国有企业取得工作机会可能是一个可以claim
的点。
另外，党籍终止可以引用党章中“连续6个月不交党费或不参加组织活动视为自动脱党
”的规定，但是这个也不能自我证明，只能看IO的心情了。
5. 近期的RFEs
大约去年2015年9月之前，党员485，前面所说的两种方法都没有听说过有问题。
之后出现了两例党员noid的例子，不过好在最后都顺利通过了，参见profile的案子，
另一个找不到了。但从近期的针对485党员的RFE来看，USCIS对CP的情况很熟悉很了解。
lasp RFE时间2016年4月11日
loopinfinity RFE时间2015年9月14日
TiffanyBB RFE时间2015年9月28日
ningyzx RFE时间2016年4月13日 pending近22月时收到RFE
luogreen RFE时间2016年4月10日，2014年9月份提交I-485, 2016,4月收到RFE
似乎RFE的case既有满足五年要求的和不满足五年要求的。
具体的RFE内容如下（参考luogreen的case）：
On Form I-485, Part 3-Section C, you indicated that you were a member of the
Chinese Communist Party (CCP) from January 2005 to 2009. However, the
explanation you provided about your involvement in the Communist Party
contained statements identified as more likely than not originating from a
commonly used template located on the internet. As such, USCIS requests that
you submit a sworn statement in your own words detailing your membership
experience and involvement in the CCP.
Include the following information in your statement.
-The amount of time you spent in the application process to join the CCP.
-Any meetings or classes that required your attendance during the
application process.
-Any other requirements you were obligated to meet during the application
process.
-Did you spend any time as a probationary member and what were the
requirements you had to fulfill during this period?
-Describe how you fulfilled any membership requirements.
-An explanation of when and why you decided to cease membership in the CCP.
Also, specify if you formally requested to be withdrawn from the CCP. If you
did not formally request your membership to be withdrawn, please provide an
explanation identifying the reasons that you did not formally withdraw you
membership from the CCP.
Please provide evidence of how your membership ended. Please include the
following:
-How did it end? Voluntarily withdrawing, or by a lapsing of the membership.
-Please provide dated evidence of your removal from the CCP membership rolls.
-Please include any evidence that the CCP acknowledged your withdrawal.
最后两条实在是难以回答了
个人猜测最近TSC增加了人手，case处理速度加快了，但是新手IO乱发针对党员的RFE。

以下是我希望与大家探讨的问题
1. 如果回复了RFE，USCIS觉得不满足要求，是NOID呢还是直接deny呢？
我猜应该是先发NOID
2. Please provide dated evidence of your removal from the CCP membership
rolls.这个问题该怎么回答呢？
引用党章的表述？停止pay membership fee时间怎么证明呢？
3. Please include any evidence that the CCP acknowledged your withdrawal. 这
个问题怎么回答呢？这简直是不可能的啊
4. 版上的成功案例很少，profile的案子最后也是准备走美国公民直系亲属豁免（I601
），当然最后他的案子最后批了，没有用到I601。我的律师告诉我，2016年之前，他们
接手的案子中，CP membership终止2年以上+statement，没有出过问题，但是2016年1
月收到一例RFE，索要CP membership终止的证据，最后也是准备走I601 豁免。版上有
没有I601成功的例子？在美国出生的未满十八岁的未成年人，能作为其父母提交I601的
理由不？

补充说明一下我自己的情况
TSC，主申，RD 2016年1月初，提交485时 CP membership终止刚满两年，目前pending3
个月，EAD和AP在手，还没有收到任何RFE。
