In 1997 British Hong Kong was handed back to China. Two documents governed
that handover. The first was the Sino-British Joint Declaration that was
signed on 29 December 1984. The Declaration provided guidelines for the
development of HK's Basic Law, which is its constitution.
The Joint Declaration states in regards the election of the chief executive:
"The chief executive will be appointed by the Central People's Government
on the basis of the results of elections or consultations to be held locally
." The nature of the elections is not spelled out, but clearly the chief
executive must be appointed by China, so the real power is retained by the
Central Government.
The Basic Law has more, if not all, legal status. Article 45 states that "
the Chief Executive of the Hong Kong Special Administrative Region shall be
selected by election or through consultations held locally and be appointed
by the Central People’s Government. The method for selecting the Chief
Executive shall be specified in the light of the actual situation in the
Hong Kong Special Administrative Region and in accordance with the principle
of gradual and orderly progress. The ultimate aim is the selection of the
Chief Executive by universal suffrage upon nomination by a broadly
representative nominating committee in accordance with democratic procedures
