发帖数: 232 | 1 简单叙述一下经过，麻烦法律达人能给点建议帮助：
21日停错车位，22号被boot了车的两个轮子，23号才看见。当日跟那个私人
booting公司的人谈，觉得此人要价太高，决定上法庭。并且发现被boot的一个轮胎瘪
了。
24，25，26日的长周末假期，一直在研究当地法律，发现只有一条city code是关于
booting company不能违反的一些操作规定的，发现其中有两三条，在本人这个case中
的这个booting company可能违反了，同时没有发现法律说不能把boot取下来。26日小
区manager让把车移走，遂于当天叫拖车拖到附近沃尔玛停车场。
27日所有地方都恢复上班后，开着自家另外一辆车（车B)去本地junk yard打算买两个
旧轮胎来换下被boot的那两个轮胎。junk yard卖轮胎的在检查本人拿去的那个瘪气轮
胎时（上面带着一个boot)，把胎拆下来后，从轮毂上把那个boot取了下来，然后检查
完说轮胎其实没坏，重新充了气，本人另又买了一个旧轮胎。然后去到沃尔玛停车场的
被boot的车处（车A），换上了买的一个旧轮胎和被解放出来的那个原轮胎，换下来的
一个带着boot的原轮胎和另一个boot放到了车B里，开回了家，此时已是晚上。
28日还正在睡觉，接到一警察电话，说是他要帮booting company取回boot。此时车B被
老婆上学开到了学校，遂带此警察去学校停车场找到了车B，警察此时打电话叫来了
boot公司老板，当着警察面，我跟老板说还是上法庭解决。此时警察便和老板一起对着
boot和本人车一通照相留证据，然后警察说他今天其实是来调查boot公司报告的boot丢
失这个case的，然后给了本人一个citation, 上面罪名是theft(misdemeaner),6月10日出
庭。
此前跟警察叙述了本人认为boot company可能违反了的几条city code,白秃肥警察表示
不认同。
还有一个重要细节，在junk yard弄好轮胎后，轮胎工和本人各抱着一轮胎往车走，此
时拆下来的那个boot被忘在了那里，是本人想起来，跑了回去取回，然后跟轮胎工说这
个是boot company的财产，他们可能需要要回去。跟警察也说了这个细节，来证明本人
没有意愿theft任何东西，警察说他会去调查。同时警察还问为什么把boot拿下来后不
还给boot公司，本人说昨天下午才拿下来，太累，所以今天一直在睡觉，而你警察又这
么快来找我了，本人还没时间去找boot 公司。
Anyway,事已至此，求建议吧。今天问了本市法院procecuter的电话，打算约谈一下，
同时也打算约个大学里的free legal councel问一下。 这种case是不是必须找律师了
？假如被法庭判theft成立，后果是什么？进jail?然后被驱逐出境？如果一审判有罪，
能否上诉？ | r******o
发帖数: 7 | 2 In order to constitute theft (or larceny for that matter), the prosecution
must prove, beyond a reasonable doubt that you have the INTENT TO
PERMANENTLY deprive the owner of the boot that you have moved. It appears
that you did not have the intent to deprive the boot company the ownership
of the boot, and apparently you just want to retrieve your OWN car.
It is stupid for a prosecutor to even bother the prosecute the case against
you. Try to settle the (civil)claim with the boot company and have them
cease to press charge against you.
I'm not sure which state are you in, you may be entitled to have a public
defender appointed for you(assuming you cannot afford an attorney and your
state provide public defender to misdemeanor defendant.) | k***c

再想问一下您说的这个“did not have the intent to deprive the boot company
the ownership of the boot”， 本人应该具体怎样来证明啊？举跟修轮胎工对话的例
子算有力的证明吗？
昨天做了件不知道是利是弊的事情---直接去找了本地法院的prosecutor,跟他说了事情
经过，procecutor倒是挺耐心听完了，表示他还要等几天后警察的报告过来，看看另一
边怎么说。但他表示第一次开庭是必须的，叫什么arrayment，本人没听说过这个词，
不知道拼写的对否？arrayment然后才是什么trial。请问这个arrayment是什么作用？
另外这个prosecutor听了叙述后，说似乎本人不是很necessary要请律师，请问这个敢
听他的吗？专门请个律师确实要花不少钱，如果本人这案子确实像您说的那样不是那么
容易给判guilty,本人有点想就让法庭指定一个算了，毕竟现在确实穷人一个。本人在
Utah。
本人今天也想过了，打算明天还是先把钱给boot公司算了，这样在法庭上说起来似乎更
理顺一些。这个也就等于是您说的settle 了civil claim了吧？ 那么在arrayment上，
本人是否还能提出boot company可能违反了那两条city code这件事情呢？

出了问题你准备找哪个ID算账？
你的问题是不拿professional当回事。 人家是专业锁车的公司，赚的就是这个钱。 你
觉得自己牛逼，能扛过去，英语字母认识几个，号称能解读法律条文，私自卸boot。现
在还不拿lawsuit当回事，不找律师却上网问
答案，人家prosecutor每个月是白领薪水的？栽跟头没关系，连续栽跟头，shame on
