我问过律师，符合申请NIW和EB-1B的条件；EB1A的话还要review不少文章，懒得折腾了。
NIW要等上太多年，因此想申请EB1B。
律师不确定是否能qualify EB1B。 我自己查了要求，感觉如果不能qualify就只有可能
下面一点出问题：
EB1B Outstanding Researcher or Professor
(C) A department of a private employer offering the alien a permanent
research position in the alien’s academic field. The department must
demonstrate that it has achieved documented accomplishments in an academic
field.
1： Tech advisor or Patent Agent 能向移民官解释成"research position" 么？
legal research 不知算不算 academic field?
2： "documented achievement" 必须要自己originaｌ research achivement 么？还
是帮client写的 patent application 也能算？这点感觉做IP的人很特殊，虽然有
documented achivement,却不是自己的研究成果。 能argue么？
想问有没有在专利所工作，申请EB-1B成功的前辈？能不能推荐有做过这个的移民律师？
另外，本来心存幻想等着今年CIR过后，搭个顺风船(STEM PHD)。不过看现在House的
GOP阻力这么大，实在太没信心了~ | B******1

generating some results/solutions useful for other researchers to copy/
follow later.
Although the subject of a patent must be unique and valuable to the research
community, the way a patent practitioner uses to write a patent is hardly
any documented research contribution to the same community.

，这条应该qualify了。
就是不知道tech advisor/patent agent的职位能不能算research position...

2难，就算可以，算“法律研究”吗？研究哪种法？prior art search? 那就是看人家
的研究，研究人家的研究，又不是真的做研究
3，问题你之前的research achievement 1 和你现在做的research 2怎么挂钩？
法律能不能申请eb1? 听说好像有人成过，不过人家是真的读法律的，研究法律，出书
发文章，有法官和教授写推荐信说了研究成果有对法学界贡献的

is for private interest and has nothing to do with research). However, I
knew a couple of people here (on this board) got NIW approved during law
school, and one person got EB1A while working as a tech spec.

发帖数: 271 | 7 I also have a friend who got his EB1A when working as a patent agent.
I consulted an immigration attorney who told me that I can go for NIW but
not EB1B, so that's probably what I'll do.
