标 题: 代友求问pending criminal case期间是否能回国renew签证

一个朋友，现在有个pending的criminal charge，不过DA说以后case应该会被dismiss
掉。她是F-1身份，暑假想回国，然后把签证renew再回来。有两种可能性：
1，她在国内等到case被dismiss掉了，然后去renew签证。这样就只有个arrest record
，这样renew 签证的话，成功的可能性大吗？
2，在case没有被dismiss掉的情况下去renew签证，这样签过的可能性大吗？

发帖数: 106 | 2 Either way the arrest record is there. The visa application will ask whether
your friend was arrested before and she has to answer yes. When the US
Consulate receive the application, they will suspend her application and ask
her to provide information on the criminal charge. She will have to provide
either a court order to dismiss the charge, or a letter from her attorney
to explain the charge and the outcome of the charge.
Even if she got the visa, she may face another round of questions by
homeland security at the airport when she comes back. She would have to show
the same documents again.
This must be handled correctly and I would advise your friend to get an
attorney immediately. | f**********2

that better not leave US in next few months. I will forward this to her.
