解这些法官的风格。看O'connor 的opinion, 几乎可以体会到她辗转难眠,左右为难的
痛苦;看souter的,会感觉到他才气不足,勉为其难;scalia 是个“愤青”; thomas
是位“狂人。”这些人都十足令人回味。 刚上来的几位大法官故事和opinion都还不
够多。估计下周会添浓墨重彩的一笔。 |

One of my Professors clerked for both Stevens and White.
My favorites are O'Connor and Rehnquist.
The most distasteful opinion in modern times: United States v. Lawrence
But this might change by Monday

的看法转变令人印象深刻。关于white,唯一记得的是他给 row 写了dissent。
我想你是想说 lawrence v. texas 吧。虽然我不完全赞同kennedy在其中的论述 (some
language is too broad to the case),可那绝对会成为他的丰碑。他也很可能因为
citizens united 而被人长久地批评。

r***l 发帖数: 298 | 7 My professor said Stevens was the most intelligent justice. He told us
anecdptes of how fast Stevens picked up computer technology in Benson. Since
he clerked for two justices in his 20s, perhaps he is uniquely qualified.
However, I don't like Stevens in Bilski, right before his retirement.
White dissented in Roe?
Yes, Lawrence got arrested in TX for alleged gay activities in his bedroom.
The language went too far, covering ONS, MNS, "consensual" prostitution,
etc. It probably opened the door to gay marriage and DOMA.
I am a conservative. I am not sure I am a damn conservative. I endorse both
Romneycare and Obamacare. Nonetheless, I think the government blew it this
time. They might lose at the narrow margin of 4 to 5. I am optimistic that
we will revisit this issue with a later administration and a modified
version of Obamacare may pass within 10 years.

o*********s 发帖数: 275 | 9 It is mostly a personal preference. With my limited knowledge, I think most
of the justices and appellate judges do not write their opinions. They
edit the drafts provided by clerks. But by all means, these people are
usually brutal editors. So when the opinions come out, the personal brand
is very substantial.
