I read the original lease, it says
TERM. the tenacy under this agreement shall commence on February 1, 2007 and
continue for continuing until February 1,2010.{This agreement shall be
automatically extended for successive periods of one year following the
initial term, unless either party notifies the other at least thrity days in
advance of the end of the the-current term in writing of its election to
terminate this agreement.}
Does | D**********s 发帖数: 320 | 2 It's the "automatic extension" term that will be valid for three years.
Before 2010, the lease will automatic extend for one more year if you fails
to notify the landlord in writing of your election to terminate the lease.
After 2010, if no new agreement is reached, the relation between you and the
landlord will become tenancy at will, meaning that either of you could
terminate the lease at anytime. Alternatively, it may become something like
a periodic tenancy, meaning that the lease is renew | e******e 发帖数: 118 | 3 thank you for your reply. I appreciate you can make me more clear:
We live there since Feb 1, 2007 and will move out Aug 15, 2008. We notify (
verbal not in writing) the landlord at the end of June of 2007.
In such situation, do we break the lease? | i****y 发帖数: 5184 | 4 since you didn't notify your landlord to terminate the lease before Jan 1,
2007 (which is thirty days before Feb 1, 2007, the first year lease
expiration date), according to the clause, your lease was “automatically extended for successive periods of one year following the
initial term," i.e., to Feb 1, 2009.
You may want to talk to your landlord, if he/she doesn't mind, you are fine.
Did he/she try to enforce the lease?
