第一，九龙坡区人民法院没有判决。只是给了一个强制执行通知书。因为法院没有使用
通常的非诉裁定。两者区别在于，强制执行通知不可上诉；非诉裁定可以上诉于重庆中
院（重庆设有中级和高级人民法院）。
第二，重庆市高级人民法院渝高法[2004]244号文件第39条第2款明确规定，“对涉及农
村征地拆迁、城镇房屋拆迁的具体行政行为不得裁定先予执行。”
第三，最高人民法院2005年的司法解释明确规定，关于拆迁安置补偿纠纷的诉讼，各级
人民法院一律不得直接受理。应由同级人民政府裁决后，再走行政诉讼程序。 | w***e

1. This is not a pure legal problem in china, I don't know weather it would
be if it were in the US
2. It got us divided, or deepened our disparity in terms of moral,
economical and social justice
3. I won't take any side in this debate, but I am very interested to know
how the court rules and whether the ruling is most justified to the its
social and legal context | w***e
