"When you make a wash sale, your holding period for the replacement stock
includes the period you held the stock you sold. This rule prevents you from
converting a long-term loss into a short-term loss."
which makes sense to me.

Short term or long term loss doesn't make a difference in a year
when your total capital gain is negative (after any previous-year
loss rollover).

Do you mean that in this situation the tax benifit is always at the marginal
tax rate no matter it's long term or short term?

I claimed net loss on both long-term and short-term last year, and I
followed the worksheet and found that they were both deductible on marginal
tax rate. I was really confused since I didn't know this rule.

that year.
For me, in the foreseeable future I don't need to worry about
this LT/ST thing, since I still have a huge capital loss
accumulated since 2008...
