if your I485 is based on family, file WOM after NC pending 60 days.
If your I485 is based on employment (EB1,2 3),
and if your NC pending for more than 6 months and less than 1 yr, sue FBI
only.
and if your NC pending for more than 1 yr, sue CIS, FBI.
