发帖数: 96 | 1 My I-140 got approved in January and on February 1, I submitted the I-485
for myself and in the meantime, I submitted I-824 for my husband who is in
China. My I-485 is still pending now. I am working under H1B visa. My
husband applied H4 visa about ten days ago and it is under background check.
He is offered scholarship from Chinese government which allows him to come
to US to work for 1 year.
What is the best solution for him. Should he apply for J1 visa? If he
applies J1 visa, is he still allowed to submit I-485 in US? | w******n
发帖数: 13202 | 2 不要申请J1，因为需要交waiver才能申请485，不然需要满足回国工作服务两年的要求。
申请waiver虽然一般都没问题，就是多了很多麻烦，大致也需要半年的功夫。
看来只好放弃国家给你老公的钱了。你老公就等H4拿到过来吧。运气好的话，绿卡半年
内就到手了。EAD如果申请了的话，也可以找工作了。
拿国家的钱很麻烦，放弃吧。 |
