Dear Sir/Madam,
This letter explains my current employment status for my I-485 application (
Application to Register Permanent Resident, or to Adjust Status) under the
E11 (also known as EB1A) category. I currently hold an offer from XXXXX in
support of my I-485 application.
I was working in XXXXX at XXXXX from XXXXX to XXXXX. I left there because I
had reached the 6-year H1B limit and am not legally eligible to work as a
resident alien. I am currently in the Change of Status to H4 visa. On XXXXX,
I accepted an offer from XXXXX to join their professional research staff as
a Research Associate. The appointment offers an annual salary of XXXXX with
its starting date contingent on my eligibility to work in the United States
. Thus, I should be able to work as early as XXXXX, 2016 as long as my EAD
card application accompanying this I485 application is approved in time. The
area I will be working in is XXXXX, the same area in which I filed my EB-1A
I140 petition.
Please be noted that as a self-petitioner under EB1A category, I am NOT
required to have a permanent job position to warrant my application. Thus my
current employment status will NOT affect the eligibility of my I-485
application as long as I will continue to be engaged in the same area of my
extraordinary ability. I believe the offer letter I supply with the I485
application fully serves this purpose.
Enclosed please find the following documents:
(1) Photocopy of the offer letter from XXXXX to prove that I will be
working in the same area of extraordinary ability as in my I-140 petition.
(2) Photocopy of the last three months’ bank statements of my financial
institute to prove that I am NOT a public charge while I am now in the H4
pending status.
(3) Photocopy of my husband’s last three months’ pay stab to prove that
I will NOT be a public charge during the time I will be in H4 status.
