们已经准备file i-485了。。。。
半个月前我突然被公司lay-off了！公司说已经向移民局发出withdraw我的H1b的申请。
求教：挂学生身份这件事是否靠谱？听说file 485之后F1就失效了？
或者我强硬file 1-485？

你们是在他拿绿卡之后结婚的吗？否则为什么要走亲属移民？
赶快在身份失去之前file就行了
申请东西不会影响你的身份。但是你这个问题是什么意思？I-485 pending的时候不需
要身份

i-485 pending 确实不需要身份，但是ＡＯＳ的前提是我在美国保持了身份。没有身份
在美国也可以ＡＯＳ？

You are in urgent situation. You can not submit your I-485 as you priority
date is not current( Current PD for you is 15MAY14 as I checked right noe).
If you submit your I-485, they will deny you application and you will waste
your application fee. Of course, you may have very little chance to get your
I-485 receipt notice (if so, you can stay legally till your 485 get denied
as you PD is not current). Obviously, you can not apply for EAD in this rare
event. Otherwise, they will find your situation and deny your I-485
immediately. You must have a legal and valid VISA to file your I-485.
Remember, people can legally stay in USA as he has I-485 receipt notice in
hand. But normally, they will not send it to you when your PD is not current.
You can transfer to F1 or any other legal status right now. You need legal
and valid VISA to file your I-485 when your PD become current. You can file
your I-485 whatever you are in F1 or H1. While you can stay in H1 after you
submit I-485 application but not F1.
It is actually very simple for you if you want to stay in USA legally.
Everyone in US has the chance to stay 1-3 more years before his/her visa
invalid or expired. Leave me a message, I will tell you how to do it.
However, if you are already out of status, you have to leave US and get new
VISA back or you have to wait your husband becomes a citizen in future, then
he can applied green card for you regardless your stay is legal or illegal.
