140/485/765/131。3月20号EAD和AP获得批准，但140和485仍在pending/review。目前
我已经在公司上班。因为H4 2/27/2014到期，所以听从公司律师的建议，在2/24/2014
交了H4延期申请。
前天收到USCIS对H4延期的RFE,说：USCIS records indicate that you were recently
granted a change of status to an H1B visa (我想应该指的是我3月20号批准的EAD
). If this H4 visa extension application is approved and that you are
granted an H4 extension, your H1b visa will no longer be valid and you will
not be allowed to work. do you still wish to pursue your H4 visa extension,
or would you like to withdraw this application and maintain your current H1b
visa status?
请教各位：USCIS上文提到的h1b是否指的是我485申请中获批的EAD？我是否应该撤回H4延
期申请，继续等待140/485审批？如果撤回H4，我目前的移民身份是什么？140/485
pending
? 是否应该等140有了结果，比如万一过不了，再申请H4延期？
实在是迷惑目前这种状态。多谢各位指点！！ |

发帖数: 198 | 3 用了ead就属于AOS状态，不需要延h4了。楼主ead批得好快，我们也是二月中递的，但
还没消息。请问楼主expedite了还是等他自然批得？

你到公司的时候就已经变成H1b?有了h1b之后在公司工作申请的eb1b?

发帖数: 147 | 7 我没有expedite.因为是从H4直接凭EAD工作的，所以希望140在拿到EAD之后有结果。我
的case有点weird：我的fingerprint fee was accepted On February 19, 2014。
scheduled 的打指纹时间是3月18号，但是在打指纹之前的3月12号，我的EAD和AP就批
了。

发帖数: 2098 | 9 这样的话，让你家老公或老婆尽量不要用EAD或AP，保持他的H1b身份。万一你的EB1B有
问题，你可以转回H4。
奇怪USCIS为什么说你之前是H1B。
祝你早点拿到绿卡。
