The response my supervisor received indicated that it is not an issue of
ownership or income, but rather performing operational services for the
business by the H-1B. Also, the business could not sponsor (H-1B) the owner/
developer because there would not be an employer/employee relationship.
Further, operational services performed on behalf of the business started/
owned is part of the US labor market, constituting “work” that an H-1B
cannot perform except as set forth in the H-1B petition. |
