d**g 发帖数: 99 | 1 I self-petitioned NIW in April this year and got approved in June based on
the on-line information posted by USCIS. However, more than 30 days passed
since then, I still have not received the approval notice.
My H1-B will be expired in about a week, and I have used it for six years.
Since I don't have the approval notice yet, my employer can not apply for an
extension for three more years. What they will do is to apply for an
extension of H1-b trying to recapture about one month of time. I called
USCIS today, they put a request for me but there was no guarantee that I'll
get a response very soon. I wonder if anyone has had such kind of experience
.
My question is: when my employer files the 7th-year H1-b extension, is the
hard copy of my NIW approval notice required? USCIS can always check the
status of my case based on my receipt number, can't they?
The worst scenario: After my 6-year H1-b expires, I still have not received
the approval notice of my NIW case, do I have to go back to China to wait or
change my H1 visa to H4 (My LD is holding an H-1b now)?
Many many many thanks! |
