说的需不需要10/1离境签h1b再回来？不知是否由此一说 其实这么做可以理解：
1）因为如果f1在10/1之前重新入境的话新i94的号码会跟拿到的h1b的i94号码不一致
不知道10/1前后能否顺利换身份；如果一直呆在美国国内的话旧i94跟新的h1b i94一个
号码肯定没问题
2）h1b批了以后离境到底cos (change of status) 是不是abandon了uscis也没有正式
官方说明 pending的时候肯定不行
不知是否有人有经验。。。望赐教 |

发帖数: 208 | 3 有啊 而且那个号码跟我现在手头上的完全一样 这样如果我一直呆在美国国内的话9/30
手头这张i94失效 10/1那张生效 两张号码一样 我觉得cos就是这么work的

are required to depart the United States. Another important noticeis that
you cannot travel outside the U.S. and come back in F-1 status during the
cap-gap extension period. If you travel abroad, you will need to apply for H
-1B visa and enter no more than 10 days before October 1 if your H-1B
petition gets approved.

好像律师说：对这种情况，有些人有麻烦，有些人没有麻烦。
Question:Travelling abroad during Transition from OPT to H1
I am on OPT Extention period and it is valid until December 2012. I am
planning to go to India in the last week of July 2012 and come back end of
August 2012.
I have following questions.
I already applied for H1 (which is effective from October 2012) under
regular processing on April 2nd this year. If I go to India for 1 month
visit, Can I return back to USA on OPT even if my H1B is Approved or still
in Pending status ?
Answer:The below is what my attorney emailed to my question today
"Regarding your question, I advise against international travel on OPT
because there are a lot of sticky issues. Several people have had problems
where the H-1B is pending or approved, while others have sailed through. I
have reviewed the current guidance and is appears that in various meetings
the government has said one who is returning from a trip abroad to the same
employer and valid student status (as indicated by a currently valid OPT EAD
card and I-20) should be alright. They donÃ￠�ï&
#191;½t think one should vacation abroad until the H-1B job starts and
those with expired EADÃ￠��s also are
not permitted to return on their F-1 visa. If you donÃ￠ï¿&#
189;�t have an EAD card and I-20 valid for the date of your
return, I strongly advise against travel in your situation.
On a practical note, you can call the CBP officer at the airport where you
will be returning and run the scenario by him/her. Be sure to jot down their
name and title."
I am confused now. My attorney is being pessimistic about travel while
transitioning from F-1 to H1 even with valid OPT and EAD.

后出境办h1b再入境 这个我也可以理解 具体理由在我原帖中有说
