from same school.
master的论文没有在OPT过期之前交上去。学校DSO认为我not eligible for OPT
extension. 我仔细看了学校的instruction和USCIS上的信息。要求三个：1. On post-
OPT 2. Have a B.S. MS or PHD STEM degree 3. E-verify employer 4. File on
time(OPT没过期之前我e-file I765). 以上条件都满足，唯一就是没有提到学位必须
是Post-OPT时的学位。
即使没有master学位， 也应该可以extension. USCIS上只提到“Thus, for example,
a student with an undergraduate degree in a designated STEM field, but
currently in OPT based on a subsequent MBA degree, would not be eligible for
an OPT extension.” What if it's a subsequent Master STEM degree??
另外，对于 OPT extension eligibility。。是USCIS说了算还是DSO说了算？？现在
Case is pending.. 是不是不能继续工作？？
请大侠指教指教。 在多次的接触中，我觉得学校那个DSO知道的也不多。 好几次都是
我给她解释一些东西。我打算直接找director弄清楚。越想越不make sense。 多谢！ | M*****k
发帖数: 1556 | 2 OPT extension，你应该可以申请的。 提交USCIS时要提交成绩单，成绩单显示你修完
课程就可以了，整个过程不牵涉到你是否及时提交论文。 | c**2

发帖数: 18 | 4 No, I did not graduate with MS during post-OPT. I only defended the thesis
and did not know need to submit thesis before OPT expires.
The OPT regulations mention that you have to complete all the requirements.
I understand that why school DSO thinks I am not eligible. But whenever I
look at the eligibility for OPT-extension requirement from USCIS and school
office instruction. It says you have to have a B.S. MS, or PHD from STEM
program, didn't say it has to be the degree during OPT. That's the part I
could not understand.

发帖数: 8496 | 5 Your OPT is based on Master's degree's I-20. When your first OPT expires
before you graduated getting that degree, your F1 ended.
If your OPT were not post-comp OPT, school would extend your I-20 so you can
graduate while your new I-20 (and thus F1 status) is valid. But because
yours is post-comp OPT, school can not extend you a new I-20, and your last
day in F1 status is the expiration date on the c3B EAD
The STEM OPT extension you are seeking is to extend your OPT based on STEM
master's degree. so your BS or PhD degree is irrelevant. |
