搞eb1b，
基本背景：
11年fresh phd，ece方向（虽然做的全是cs，硬件完全不懂。。），现在一家IT大公司
当码工刚刚整一年
phd期间publication
8 journal（3 first authors）
8 conferences（4 first authors）
90 citation（不多，没办法，做的方向过了hot的时期）独立大概60
40+ journal reviews for more than 6 journals
30+ conference reviews for more than 5 conferences.
询问了公司的律师，publication 和 citation这部分应该ok（based on the academic
record, it might be possible for an eb1b petition)
但是律师有个问题，"one other issue before we proceed with eb1b petition is
the percentage of time that you spend on innovation research for your
current position in XXX company, it should be over 51% to eligible for eb1b
outstanding scholar claim.)
我很奇怪这个51%怎么定义啊。。大家SDE申请的时候都是怎么对付这样的问题的？另外
，我搞不清楚公司请的律师到底能不能够跟他交底，比如现在实际上大部分做的就是
engineer的（不然也不叫SDE了不是), 想他请教应该怎么吹成要有innovation才能完成
XXX projects之类的。因为我感觉这些律师应该跟公司是一边儿的把？
现在真的是没有头绪，看到了点儿希望不想就这么因为这个奇怪的51%而放弃，劳烦过
来人多多指教，不生感激！
p.s., 我知道公司里同一个部门的同事similar背景（SDE + fresh phd + publication
/citation/review)最后是给开始办eb1b了，但是他没有遇到这样的51%的问题。。我就
在想这个难道真是不同的律师情况差别这么大。。

发帖数: 24532 | 2 睡觉前re一下，你的case 1b还是有fair chance的，那个51%就看你们公司律师是否灵
活了。原则上讲，你的职位必须是research oriented的，律师认为你的只是个玛工那
你就得找领导来从中调和了。通常说，只要公司出具证明你的是个research position,
那就没问题了。

a breakdown of your job duties would be helpful，
Here is the description from the H-1B, and you can edit and expand on it to
show how your duties involve pure research and development more than 50% of
the time:
As Software Development Engineer Mr. XXX will use current technologies and
software tools to build software that works well within the overall system
architecture, as well as build software solutions where the problem is not
well defined. He will own the delivery of an entire piece of a system or
application, and participate in the scoping and planning process of larger
projects, effectively analyzing the technical risks to the project. Finally
, he will serve as a technical lead on small to midsize complex projects,
and provide work leadership by assigning work to junior-level Software
Development Engineers.

。所以现在需要改动，但是具体怎么改，我问了manager，他说他也支持，但是不知道
怎么改，(当然了，他表达的意思是最好不要让他make up anything..), 这也是我想请
教前辈过来人的地方，呵呵
不知道有没有什么模板之类的，因为我应该不是第一个需要这么做得吧。（SDE title

如果你改动很大，就要file H1 amendent as well.
主要就写research，
比如说，responsbility:
Research on algorithm used in mobile computing in windows phone platform etc.

发帖数: 220 | 12 哦，可能没有说清楚，我不是perm悲剧，是正在准备eb2的过程中，听说还能办eb1b，
就跟律师问了下，然后律师说那如果要变eb1b的话，那个为eb2准备的jd就不能用了，
要弄新的。现在eb2的流程还在走，还没有到打广告的阶段。。 |

个怎么解释啊。。如果以这个为标准，不是很多公司都应该可以吗？ |
