版上藏龙卧虎，帮我看下吧，实在不知道咋整，发rfe给几个律师，有一个愿意以新case的价格（不
便宜）接，有个说media report够呛，委婉拒绝，有的还没回复。实在不知道咋整了，大家给点
建议吧。
一共claim了三项：contribution，media report，publication and authorship. 我
没有review，万不得已只能claim了media report，但有律师说1a的media report必须是
针对本人的而不是文章啥的，但我的恰是对文章的，IO恰好也提到了这个不足，总之是感觉凶多吉
少，很难address这点。还有就是我根本没有claim这个prize，只是把这prize放到
contribution里面用以支持contribution，但io却针对我的prize comment了一大堆

This criterion has not been met because the evidence submitted does not
show that the beneficiary’s contributions are considered to be of major
significance in the field of endeavor. The letters of recommendation
suggest that the research may have had some significance. However, no
independent evidence was provided as to how much of an improvement the
beneficiary and his associates research has been compared to what was
previously used. Additionally, the recommendation letters used
descriptions such as:
“this work filled in a niche and is appealing.”
“It is out of doubt that Dr. BIGWONIU’s contribution and achievement is
superior to the most of the peers at his level.”
“Dr. BIGWONIU’s excellent work opened an uncharted avenue and I am
confident this avenue will lead to great discoveries in the future.”
The first statement is hardly descriptive of significant research. The
second statement indicates the beneficiary may be towards the top of his
peer group. The third statement indicates the beneficiary’s research may
be significant sometime in the future.
The number of publications and citation index, seven publications and 51
citations, are minimal for someone who is considered at the “small
percentage at the very top of the field.” Generally, researchers at the
top have been published numerous times and their publications have
received hundreds of citations.
The beneficiary is an early career professional that does not yet have
the extensive publications or citation record usually associated with
this classification.
The emails provided were mainly from students and a few researcher from
different universities to the beneficiary asking questions about this
research. This does not appear to be unusual. The exchange of ideas in
academia is should expected and quite common.
The evidence presented should support the conclusion that the
beneficiary is in the top percentages of his field. This evidence should
be able to clearly demonstrate that the beneficiary stands apart from
others in his field. The academic requirements of a doctorate degree
demand original research that is worthy of publication in peer reviewed
journals. However, not everyone who has completed their doctorate could
immediately be considered at the very top of their field.
To assist in determining whether the beneficiary’s contributions are
original and of major significance in the field, the petitioner may
submit:
• Objective documentary evidence of the significance of the
beneficiary’s contribution to the field.
• Documentary evidence that people throughout the field currently
consider the beneficiary’s work important.
• Testimony and/or support letters from experts which discuss the
beneficiary’s contributions of major significance.
• Evidence that the beneficiary’s major significant
contribution(s) has provoked widespread public commentary in the field
or has been widely cited.
• Evidence of the beneficiary’s work being implemented by others.
Possible evidence may include but is not limited to:
o Contracts with companies using the beneficiary’s products;
o Licensed technology being used by others;
o Patents currently being utilized and shown to be significant to
the field.
Note: letters and testimonies, if submitted, must provide as much detail

detail, how the contribution was “original” (not merely replicating the
work of others) and how they were of “major” significance. General
statements regarding the importance of the endeavors which are not
supported by documentary evidence are insufficient.

个人认为既然你没有claim prize和review，就不要和IO在这个上纠缠。看来IO承认了
你的authorship,这是好事，就不用管它了。把重点放到media report和contribution
上来。

说明你是这些文章的主要贡献者。因为我没有claim media report,也想不出太多的建

关于contribution，感觉你的推荐信不太给力，里面一定要强调你的工作对推荐人有着
多大的帮助，对整个领域有着巨大的贡献。这里要用的时态是完成时，“已经”，而不
是将来时。再补几封推荐信吧，独立推荐人的，一定要strong。
好好准备吧，关键在自己的条件。不要着急，很多人都是RFE后过的！万一过不了就赶
紧攒review，我在10个月内就攒了25+了。

先简单的讲一下我的看法，刚回来，没来得急细看。 你的材料的组织有很大的问题，
要放在半年前基本上肯定是RFE的，放在现在大好形势下都要RFE你，我感觉你除了内容
性问题，还有结构性问题。
我先说结构性问题，
1) 选择claim media report 是最容易被RFE的一个方面，这也就是大多数同学们如果
非不得已不选择这个的原因，因为media report要求的是知名刊物，并且是有名有姓的
报道。这个被RFE得都不知道多少了。
2）你的材料组织上存在问题，给什么材料和不给什么材料没有区分清楚。给的材料都
是弱材料，没有强材料，比如说只给个啥award? 如果和你的研究项目无关，非
internationalized的肯定被challenged, 比如说你给了什么别人邀请你审稿的信，而
你还没有干事情的邀请信。这样的email,丢出去不会有人信的。你居然没有别的证据吗
？换句话说，在不能随便发模板RFE的今天，这个IO都已经看不下去，实在是要给你写
上一些你的名字，你老板的名字的一些内容来给出RFE啊。
（补充一下，看到你说的奖是挑战杯，你简直给自己挖了一个深坑啊！这个挑战杯和研
究没有任何关系，你送上去后面都很难圆场啊）
我再说说细节问题，
其实我的RFE系列里面一直强调了RL的重要性，以及如何编织RL. 而你的RLs 被批得体
无完肤，写作上没有花什么功夫。 这一点上，我其实一直很想写篇文章，不过后来老
枪genegun写了一篇，还实例分析他的写法，和我想要说的是一样的，所以作罢。
总结一下，你既然已经被RFE了所有，基本可以认为你要从材料组织，材料准备，材料
复核等环节在接下来的87天完成。
1） 对于挑战杯的事情，这个是学生奖，现在我没有想好如何处理。因为这个你怎么给
都可能被质疑。我在想是否干脆withdraw，重新file，把这个东西抹掉。
2） 你要再找出至少4封推荐信，1封是你老板，着重强调与新闻报道中都是你干的，没
有其他associate, 或者主要就是你干的，这样才能支持你的media report. 2封来再次
展开你的工作如何影响到他们的研究的。注意，你再去读读老枪的那篇如何写RL 牛逼
文，实例讲解。还有1封你可以考虑放在别的闪光的地方，比如你做过session chair,
TPC吗？
3） 重新组织新的证据加强影响力。在无更多citation的情况下，借用美版Kathy的另
类citation看看有没有新的发现。
4) 开始赚review, 不管这次用不用得上，因为有review的一个最大好处不是review本
身，而是能够拿到一封editor的信给你再添一些财火。
整体上我个人感觉，你的机会有，但是要花费很大努力及借用大好形势才行。我个人不
排除withdraw,利用重新组织的材料，新refile + PP这个选项。 当然我这是我个人的
看法，你也多听听别的同学的意见。

这里的意思就是对claim媒体要千万小心。不是非常solid就不要claim.
现在就只好看怎么能把这个场圆了。我觉得现在想不claim也不行了，不如就按IO说的
，找这个评奖的标准，把标准想办法吹高点。获奖人数的比例吹少点。然后按大蜜蜂说
的，让导师出信说那媒体的工作都是你做的。

这个挑战杯的奖是不应该claim,律师不专业， 其实你当初就不应该告诉律师你有这个
奖。如果不告诉律师，他肯定也没法claim。我当时大四的时候也获得这个全国挑战杯
的三等奖。我在所有的材料里都没有提，因为在写pl的时候我就在这个版面上咨询过。
但是既然你已经claim了，我觉得你还是的好好回答。这个奖其实应该算是national
award，但是你要把他包装成学术奖，不能让IO觉得是一般的竞赛奖。你可以到网上所
搜一些材料。据说这个获奖证书里的字是老江提的，我没有考证，但是我看那个字也确
实有点象老江的字(我说错了大家别打我....我只是听说).如果真的是老江提的字，那
就可以找找证据好好吹一吹。还有IO要的有关这个奖的描述，获奖范围等一些材料你到
网上好好找找，有用的就放上去，没用的或者有副作用的千万别放。

其实很正常，有些IO看到你的那些media report什么的，就会考虑你是不是qualify这
些criteria. 我被NOID的时候，IO也质疑了我根本没有claim的media report,
membership, prize等。
我也感觉你的PL写的可能有问题，没有把你的case包装好。
我重新申请的时候把我的PL重新写过，把我的支持材料全部整理一遍，拿掉了很多看起
来不是太strong的材料，补充了一些辅助材料，比如找了一些材料来证明我获得的那个
奖。
再强调一次，申请绿卡运气是第一重要的，祝你好运吧！

说实话，你的rfe，其实IO挑的挺有道理的，这case律师准备的比较粗糙啊。

1. 没有审稿证明的那个，两条路，1.不回复，2。反正你也没claim review这条，直接
找当初找你的人出推荐信，只说明他们选择的标准很严格，证明你牛他们才慕名找你的
2. media report单独claim向来是io见了就想挑毛病的。挑战者杯，想法子从网页上找
找，吹它是national的看看行不？这明明是个学生奖啊，贵律师胆子挺大的。关键是其
他几项不强的话，容易中枪。media report 主要是针对你老板的话，找老板出证明，
证明至少是equal contribution。自己人，好说话一些，脸皮要厚。
3. citations 51个，你找到你说的80多的，证明给他看。但是不要直接反驳他那51，
重新组织一下，什么油灯图啊，多个研究所啊，强调确实是81个。
总之，每一个都要下大力气回复，否则，不好过。。。。
