发帖数: 8496 | 13 you can file I-485 now (if EB1), because you file AOS after your J1 waiver
approval. long time ago (before 2005) people could file I-485 first with
DOS favorable recommendation, and submit J1 approval notice later. But
around 2006-2007 there were several people with I-485 RFE having new
language like you must submit your J1 waiver approval notice showing
approval date BEFORE I-485 RD and that killed several people's AOS case.
USCIS no longer approve people who file I-485 before the approval of J1
wiaver. |
