I would like to get your input on the umpleasant situtation currently
happening with EB1 (employment-based immigration, first preference) i-485
petitions adjudication. Starting from August, 2011 adjudications in this
category came to almost complete halt. According to the trend observation,
before Aug 2011 the usual timeframe between I-140 petition approved and I-
485 adjudication was 10-20 days (often the petitions were adjudicated next
day). However, in Aug 2011 this practice stoped.
Myself (your name) as well as many other people I know now have our cases
pending for months after our I-140 petitions were approved. We also have
seen that starting from FY2012 EB2 India received twice their alotted yearly
visas (XXX vs YYY put numbers here, I do not remember exact numbers). And
those petitions were already adjudicated.
Together with our adjudication being pending this assumes EB1 visa numbers
were used for EB2 category and as a result EB1 petitions can not be
adjudicated despite being current according to DHS Bulletin. This situation
is alarming, as it consitutes clear violation of INA Act.
Meanwhile people are receiving absolutely meaningless reponses from USCIS
regarding their pending cases, for example ... (put an example of earlier
response in this thread, where they said 'visas might be available, or might
be not'.
All facts considered, I have a striong suspicion something is not working
properly in USCIS with regard to EB1 petitions adjudication. Thereby, I
would like to ask you to attend to that matter.
