without PP. In that case, I can get AP and EAD in about 10 weeks (so that I
can continue working) without my I-140 application being processed. Is this

发帖数: 86 | 2 Yes, I got my EAD/AP 10 days after premium processing I-140/I-485
concurrently.
One may use the EAD card to work even without I-140 approval, but it is
risky. In the worst case that I-140 eligibility is denied, one has to leave
USA within certain days. In practice, people can either appeal or use MTR (
motion to reopen) to postpone the EAD revoking date. This is my personal
understanding, you may consult with the attorneys. | J********n

My lawyer doesn't want to do PP for my application. She thinks that there is
a good chance that my I-140 will be approved and PP might lead to RFE. And
if I would file the application without PP and unfortunately get a RFE,
there is a 3-month window so that she can help me apply for Eb2 as a backup.
I still need to decide on whether I will do PP or not. | l****z

As long as you don't use your EADs, the H1/H4 status is intact.
If you use your EAD, but your LD does not, then his H1 will be okay, but
your H4 status is gone. You may get back to H4, well, quite possibly you
need a visa stamp from outside of US.
