It also means that when you are back to US (before 485 is approved?), you'd
have to have a valid H or L visa to return. So if you only did status of
change in US, you need to get a visa stamp in China, which is subject to
visa approval risk.
If she doesn't have a visa stamp, she may have to wait till the green card
is made and mailed to her.
When 485 is filed, there's slight chance that it may get RFE, etc, how
should the person respond if she's out of US? |

Does 485 application require the applicants to be in US? Probably not. Who
can confirm it?
If your LD's H4 is still valid, she can come or go whenever she wants as
long as she's on her H4 visa.

you elaborate more?
Pjiang mentioned that once the 485 is filed, only H/L visa holders do not
have to stay in US, but he didn't mention that the person has to be in US
while 485 is filed.

once the 140 is denied, you'll lose your status immediately. You can't go
back to non-immigrant status. That's why people are cautious in using their
APs.

I have to elaborate it here again.
There's also the ambiguity between AP and EAD. Somebody claims that using AP
may not completely change your status from non-immigrant visa status to AOS
, it's kind of like a soft-usage, and it might be ignored by some officers.
It is a gray-zone.
However, using the EAD is a hard-usage of the immigrant status, and once the
EAD is used, you can't go back to the non-immigrant visa status. There's no
ambiguity here.

you have to use counselor processin which is a different application an cant
be directly link to 485.
But the way uscis checks whether you are in us or not is the record of I 94.
Since your ld left from Canada so probably it's hard to track at least not
soon, and she will come back with valid h visa, so I guess it will probably
be fine. But be alerted that uscis might ask for the documents showing
valid status such as passport , I94.

if you were not in H/L visa status, it can 影响485. When deciding your case
, officer needs to check several facts including: 1 where were you on the
date USCIS received your I-485? If you are not in US --Deny. 2: is there
record of your reentry after I-485? if yes, did you use AP that was approved
before your trip, r did you use H/L visa? if violated --Deny, if not clear
--RFE for your new I-94s. |

。ld现在是H1，还有有效的H1 stamp。但是下个月就没有身份了。我目前是H1，8月底
过期，正在renew，不知道什么时候能够收到，学校办事效率太慢，现在还没有递上去
，说是要等prevailing wage. 我5月份已经发信让系里秘书办了。
1）如果ld8月份没有收到AP回去，可否签H4回来？
2）如果ld在国内的时候，我的H1renew还没有下来，而这时候485批了，我可以把绿卡
带回去给ld，让ld用绿卡回来吗？
