亲属移民 四类
(一) 配偶移民的条件
配偶移民包括两种人士：第一种是美国公民的配偶，该类移民不受配额限制，只
要提出申请，可很快获得批准；第二种是在美国持有绿卡者的配偶，该类移民要
受配额限制，属于优先移民类别的第二类。
(二) 子女移民的条件
根据美国移民法，申请子女移民主要以下四种情况：
(1)美国公民未满21岁的未婚子女，可以申请移民不受名额的限制；
(2)如果子女已经满21岁，但是未婚，属于第一优先类；
(3)如果子女已婚，则属第三优先类；
(4)持有绿卡者也可以为他的未婚子女申请移民，受益人属于第二优先类，对于
离婚子女，视同未婚。持有绿卡者的已婚子女，不在优先之列。
移民法对“子女”作了如下的解释：
(1)婚生子女；
(2)继子女，只要其生父和继母或生母和继父结婚时，该子女未满18岁，他就拥
有继子女的身份；
(3)非婚生子女，可借其与生母或生父的关系寻求移民身份，假如他们之间确实
存在血统关系的话；
(4)收养子女，养子女在16岁以前，由养父母合法收养，并与养父母同住至少两
年。
这里所谓的父母，不但包括生父、生母，也包括继父、继母、养父、养母。原则
上，提出申请的子女，应该证明亲子关系的存在。有一点应该注意的是，养子女
与亲生父母的关系，因为收养而终止，所以养子女取得公民资格，不能为亲生父
母申请移民美国。
(三) 兄弟姐妹移民的条件
美国拥有公民资格的人士，只要年满21岁，均可申请其兄弟姐妹移民美国，在
亲属移民的优先类别中，属于第四优先。而在美国拥有永久居留权的人士，则不
能为其兄弟姐妹，而且也包括同父异或同母异父兄弟姐妹。不过，这种继兄弟姐
妹的关系，应在18岁以前就已存在，否则不得享受移民法上的权益。
(四) 同行家属移民的条件
为了使移民家属不致分离起见，移民法对已核准移民的同行家属，有特别优待的
规定。取得以上任何一类优待身份的移民，其配偶和未满2l岁的未婚子女，如
果与他同行或随后到美国团聚，都可获得同类优先移民身份资格。

EB-1(b)要求申请人必须：
+ 获得永久性研究职位或者终身教学职位的承诺,并由雇主支持申请；
+ 至少三年的相关研究经验或者教学经验；并且
+ 在某一科学或学术领域获得国际性认可，有一定的个人成就国际性
知名度；
EB-1(b)的申请不需要劳工证，但是在进行这项申请时，未来雇主（如大
学或其它研究机构）必须提供具体的工作职位，并在I-140申请中作为申请人。
o 跨国公司主管/经理EB-1(c)：
跨国公司经理/管理人员EB-1(c)类移民申请，主要适用跨国公司的高级管
理人员移民到美国，成为永久居民。
EB-1(c)的要求如下：
+ 在过去的三年中,受益人必须在美国雇主的海外机构(如母公司、子
公司或者分公司)工作过至少一年，而且他/她必须在美国从事经理/管理工作；
+ 雇主必须在美国境内及美国以外的国家进行业务运营，提供经常，
连续，系统的商品和服务；
+ 雇主必须在美国已经存在至少一年。
EB-1(c) 的申请也不需要劳工证，但是在申请时，未来雇主必须提供具体

* 职业移民第三优先 （技术/非技术工人EB-3）：
职业移民的第三优先类别包括熟练工人(Skilled Workers)、学士学位持有人以
及其它工人。 第三优先类别的名额也为每年约40,000个（占职业移民名额总数的28.6%
），以及本年度第一和第二优先类别的剩余名额。 但是，非熟练工人(Unskilled

申请的批准。 特殊职业移民需要进行I-360申请，但美国政府的海外雇员例外，他们使
用DS-1884申请。 第四优先类别包括以下几种具体情况：
o 宗教工作人员， 包括为宗教组织工作，具有职业素养和才能的牧师，宗
教工作人员或在宗教组织中参加一项宗教使命的人士；
o 美国政府的特殊海外工作人员；
o 前巴拿马运河公司的工作人员；
o 国际组织的退休工作人员；
o 国际组织工作人员的家属；
o 美国军队成员。
* 职业移民第五优先 （投资移民EB-5）：
EB-5投资移民的名额占全部名额的7.1%。EB-5申请人需要提交I-526申请。为了
满足这一类别的申请要求，申请人根据投资地区僱傭率的不同要投资$500,000 或 $1,
000,000， 并为美国公民、绿卡持有人及其它合法居留人士提供至少10个工作机会(投
资人及其家庭成员除外)。

(一) 配偶移民的条件
配偶移民包括两种人士：第一种是美国公民的配偶，该类移民不受配额限制，只
要提出申请，可很快获得批准；第二种是在美国持有绿卡者的配偶，该类移民要
受配额限制，属于优先移民类别的第二类。
(二) 子女移民的条件
根据美国移民法，申请子女移民主要以下四种情况：
(1)美国公民未满21岁的未婚子女，可以申请移民不受名额的限制；
(2)如果子女已经满21岁，但是未婚，属于第一优先类；
(3)如果子女已婚，则属第三优先类；
(4)持有绿卡者也可以为他的未婚子女申请移民，受益人属于第二优先类，对于
离婚子女，视同未婚。持有绿卡者的已婚子女，不在优先之列。
移民法对“子女”作了如下的解释：
(1)婚生子女；
(2)继子女，只要其生父和继母或生母和继父结婚时，该子女未满18岁，他就拥
有继子女的身份；
(3)非婚生子女，可借其与生母或生父的关系寻求移民身份，假如他们之间确实
存在血统关系的话；
(4)收养子女，养子女在16岁以前，由养父母合法收养，并与养父母同住至少两
年。
这里所谓的父母，不但包括生父、生母，也包括继父、继母、养父、养母。原则
上，提出申请的子女，应该证明亲子关系的存在。有一点应该注意的是，养子女
与亲生父母的关系，因为收养而终止，所以养子女取得公民资格，不能为亲生父
母申请移民美国。
(三) 兄弟姐妹移民的条件
美国拥有公民资格的人士，只要年满21岁，均可申请其兄弟姐妹移民美国，在
亲属移民的优先类别中，属于第四优先。而在美国拥有永久居留权的人士，则不
能为其兄弟姐妹，而且也包括同父异或同母异父兄弟姐妹。不过，这种继兄弟姐
妹的关系，应在18岁以前就已存在，否则不得享受移民法上的权益。
(四) 同行家属移民的条件
为了使移民家属不致分离起见，移民法对已核准移民的同行家属，有特别优待的
规定。取得以上任何一类优待身份的移民，其配偶和未满2l岁的未婚子女，如
果与他同行或随后到美国团聚，都可获得同类优先移民身份资格。
