回答: 2005年3月28号以后, 所有Labor Certifications的办理都要通过PERM
regulations. 绝大多数基于雇主(或者雇主支持)的移民类别(EB类)都要求第一步先办理Labor Certification. 只有如下几类例外不需要labor certification through PERM Process:
1) EB-1s: EB-1A 特殊人才类 (An Alien of Extraordinary Ability), EB-1B 杰出研究人员/教授 (Outstanding Researchers/Professors), EB-1C 特定跨国高层管理人员 (Certain multinational executives and managers).
2) EB-2 NIW 国家利益豁免类 (National Interest Waiver) - 拥有高学位或者出众才能,且所在专业和工作(已经)对美国国家利益有着显著突出贡献者.
3) EB-4 (某些特殊工种类) 宗教工作人员 (Religious Workers).
4) EB-5 投资类移民 (Employment creation or Immigrant Investors).
